No offense but you are out of your depth here. The fact that he pleaded the fifth when he presumably had immunity is likely a Supreme Court issue. All the facts surrounding this make it clear that the nature of the pardon is inappropriate and not contemplated in the constitution.

Further, the fact that the little cocksucker had an opening statement that calls out the committee and senator Paul undermines not only the position that he has taken to plead the fifth but also his own pardon that should give him immunity over the matter.

This is a way more complex than “he should have been honest”. This man caused the most expensive shite storm in the world’s history and now he is is going to top it off with an intense legal debate that is legitimately gray. You say he can be convicted of contempt, but we don’t actually know the answer to that.

None of us would be in his position, that’s the point. You either did the best you could, tell the truth and lean on your pardon or you fight like hell and maintain you have done nothing wrong. Him taking the fifth is yet another selfish act that will consume major US resources- that is why there is outrage and if you think it’s laughable maybe you should pay attention to something else that’s actually funny.

Yeah, he has a pardon for things he might have done prior to its issuance but he's not protected for things that could have been said yesterday. He did not have immunity going into that hearing. If he had immunity things could have been different and you could prosecute for contempt.


This is illogical.

It sounds like you think he would need to have immunity for lying under oath to be compelled to testify.

This is incorrect. The Supreme Court has ruled that you CANNOT plead the 5th to avoid potential perjury. The 5th only applies to past crimes.

This is settled law. SCOTUS has ruled on what the 5th allows in numerous cases. Key points that came out of these cases:

1) The 5th only protects you from past crimes, not future ones.

2) You cannot plead the fifth if you already were guaranteed immunity (or have a pardon).

3) You do not get to take the stand and "pick and choose" which questions to answer. Once you take the stand, you either plead 5th for all questions or none of them.

4) You do not get to lie on the stand and claim that the immunity makes you immune from prosecution for perjury (This is what Glickstein argued in 1911). In other words, once you are immune, you must tell the truth on the stand even if it makes you look like a scumbag. The Fifth is not designed to protect your public reputation - it is only there to keep you from being compelled to help prosecute yourself.
