The problem with all of this so far is that there is no compelling argument that state charges would ever stick because his "crimes" would end up being something done under his federal duties. Courts evaluating a Fifth Amendment claim look for a realistic fear of prosecution, not a purely speculative one.

I think the more he does this, the more likely either a contempt of Congress prosecution can move forward, or it becomes a major SC question.
