Actually as I read the decision, The OP is closer to the truth than he knows. Taken along its course and way of thinking by the Plaintiffs in this matter, 14th Amendment as well as 5th Amendment protections not only apply to resident aliens, which it should, but it also applies to all persons approved for an immigrant visa as well as those who have applied for an immigrant visa.

The Ninth Circuit is basically saying that you really can't tell any "refugee" no if the paperwork has been filed AND you especially cannot tell them no even if it has been approved but the person has not left his/her home country.

Read the decision in depth and then take the four corners approach to reading it

How did you reach this conclusion? And even if they are saying applicants have due process rights, that doesn't mean it can't result in a NO.

You don't find the prospect that an applicant in Mogadishu is covered by due process rights troublesome?

I came to this conclusion by listening ad reading the arguments of the Plaintiffs and then referencing some of the case law being cited by the panel. They seem to think if not outright say that because you applied, you get some rights. That should not be the case.

They said that lawful permanent residents have a due process right and that the EO at least potentially denies them the right to enter without due process.

It's probably unnecessary, but it's not troubling if the "rights" are applicable to the process.

I guess I would argue the application and vetting process itself is "due process" in practice as long as the procedures and decisions are consistent, justifiable, and fair.

Uhhh, nope. There was a time when that was in fact true, everyone in or held by the US had rights under the 4th, 5th and 6th amendment, regardless of anything else including nationality. Bush vs Boumadine settled it (off the top of my head so that's probably wrong), but SCOTUS later went back on that somewhat, and the US can legally hold people without giving them due process rights like speedy trial.
