You can not deprive a defendant of his constitutional rights based on the behavior of a witness.
So that's where Merchan's line is. He's not saying he will do this; he's saying based on that Merchan wouldn't even hesitate because he's already gone much further.
Costello should be filing with the NY Bar and Supreme Court with Dershowitz as counsel yesterday to sanction Merchan.
