Cuomo Ends Gun Manufacturer Immunity, Announces Plan To Sue Them Out Of Existence

Cuomo signed into law yesterday an order that allows prosecutors to hold gun manufacturers responsible for gun violence that can be linked to the manufacturers marketing and business practices. This is essentially public nuisance liability for gun manufacturers.
“I look forward to prosecuting the public nuisance law and I stand ready to defend it against all legal challenges.”
- Letitia James, NY Attorney General
“The governor’s decision to issue yet another executive order and declare gun violence a public health emergency is another example of his incessant need to circumvent the legislature and dictate policy from his bully pulpit.”
- William Barclay, NY Assembly minority leader

New York Enacts First-in-U.S. Law to Limit Gun-Liability Shield; legislation uses public nuisance law to bring civil lawsuits
quote:
New York Gov. Andrew Cuomo (D) on Tuesday signed legislation that makes it easier to bring civil lawsuits against gun manufacturers and dealers by bypassing the blanket immunity provided to the industry under federal law.
quote:
The measure (A.6762B/S.7196) is the first-of-its-kind in the nation and would allow sellers, manufacturers, importers, or marketers of guns to be held liable for a “public nuisance,” defined as actions that harm the public, according to the new state law’s language.
quote:
The use of public nuisance law is thought to be a sort of legal loophole to work around federal protections.
quote:
President Joe Biden (D) has said he supports repealing gun manufacturers’ immunity from liability.
quote:
The federal law allows states to pass these types of laws, which permit civil liability actions against gun companies when they violate state law, said Jonathan E. Lowy, chief counsel and vice president of the nonprofit Brady United Against Gun Violence, which worked to get the law passed in New York.
quote:
“Litigation against gun companies has proven to be one of the most effective ways to reform the dangerous gun industry and it can save lives,” he said.
quote:
The legislation aims to hold manufacturers and retailers responsible for the criminal actions of a non-associated third party, and would be “very harmful” to the industry, said Mark Oliva, director of public affairs for the National Shooting Sports Foundation, a firearm industry trade association.
quote:
And the law is written in a way that would allow people in New York to sue retailers and manufacturers in other states, Oliva said.

Executive orders are not laws.

Note: I noticed Jack’s thread regarding Cuomo’s declaration of gun violence as a public health emergency. However, his thread focuses more on the health and law enforcement aspects and doesn’t really focus on the legal immunity aspect.

Does anyone really think we’re not in civil war at this point? It’s the sane and liberty minded vs the tyrannical and woke. Actual liberals: wake the frick up. The later will strip you of your rights. I merely disagree with you about tax policy. The Woke will take everything from you.

Seems the companies could simply ignore requests to appear.

Did this distinction matter during Covid?

Fast food chains kill more people. They must be nervous.
This is a blatant attempt to disarm us via the courts.
They do want war.

Can we sue the parents for manufacturing a murderer too?
How is the gun manufacturer more liable than person who created and raised the one pulling the trigger, if this logic made sense in the first place of course
Crime seem like a public nuisance to me… Who is manufacturing these criminals!

I live in a very lib state but small rural county. Most sheriff and state attorneys didn't prosecute.

They hate you. They also don’t want to let you leave. They want to subjugate and control you.
We’re locked in a fight. And a lot of people still don’t realize it or care.

Actual liberals like Bill Maher, Sam Harris, and Sarah Silverman need to realize and quickly that there’s now only one side fighting for liberty. They’re so close, they just need to realize that the Democrats in general are the enemy.

They will move... If I was a manufacturer, I would move out of New York entirely... I would not allow a new firearm to be shipped to or sold in New York...
Ammo manufacturers should do the same...

Lol this would be interesting to try out. They should totally do it.

Funny...I see a lot of ads for firearms and I don't recall a single one hyping the product's utility and function in committing crimes.

They could try.
But a judgment can still reach them.
