And no one is arguing for him to stay here on his own merit. Return him, present him to a neutral magistrate along with the evidence on his gang ties, and argue for the removal of the hold order.
Seems like they have enough to get the hold removed and then send him on the next plane out.
But the process is what everyone sees being flouted and it’s not hard to imagine where that can go next.
The hardest cases to argue for the rule of law are the ones with the most repugnant defendants. Same thing as defending free speech.

This case COULD have been as simple as....
He was here illegally (already had 2 hearings for the "but muh process people) and was thus returned to his country of origin. Period. No need for all the extemporaneous info. No need to pile on.

But it also grants an injunction against the removal of ANY of the putative class members until then (not just removal under the AEA).
If you are going to essentially grant the relief, you may as well take up the case

That's really a huge statement of ignorance.
Congress has already acted. In fact, the US Constitution grants Congress the primary power to regulate immigration, including naturalization, but also outlines the President's role in enforcing these laws and exercising discretionary powers. The President has broad authority to suspend the entry of certain aliens deemed detrimental to the US, and to administer immigration laws through executive actions like deferred action.
