Far from arguing their creativity can't be reviewed, they've appealed the initial ruling.

The problem here is NOT review.
Quite to the contrary, the issue here is another apparently conflicted Judicial pipsqueak is attempting to elevate himself over the Executive Branch through TRO abuse without review.

Had he heard the evidence, issued a finding, and allowed the appeals process to take its course, we wouldn't be having this discussion.

The TRO abuse targeting Trump is breathtaking and has the ability to set up Constitutional crises. TROs in every single instance put the Judicial Branch in a position of primacy over EB matters. The claim of no-harm, no-foul because it's "only temporary" does not change that fact.

He was. Cannon was correct.

The DOJ dismissed the appeal before this could be adjudicated. Likely to ensure she was not overruled (and to avoid arguing against their "unified Executive" theory, which would permit them to appoint special prosecutors in this manner).

Because the Executive isnt acting like it, they are doing it. Per Article II. A lower court judge has no authority over the president in certain affairs of state
