What i don't understand is how is prop 50 constitutional? Surely if they redraw districts, courts would eventually have to intercede if anyone were to try to take it to court.

I think what some are saying (on the left mainly because the right won’t admit it in Texas) is that if the Latino vote does shift back to where it more rationally has voted that these new district lines may backfire on the Texas Republican Party.

The SCOTUS made it pretty clear that the way districts are allotted is up to the state legislatures in the NC case a few years ago. Thus, washing their hands of future gerrymandering cases. This, mixed with Citizens United, has done so much damage to our democracy and continues to drive significant party polarization.

That’s not the implication. In fact, there is no implication; there is a statement of supposed fact: that the Latino vote has swung back to where it was before the Trump surge, which included non-zero support for Republicans. If it was 40% before, then it’s 40% now.

Why wouldn’t it be? Plenty of state legislatures draw their lines. Prop 50 just gives that power back to Californias legislature from the commission it had been using.
