Maybe?

The panel ruled 2-1, with two Republican-appointed judges carrying the majority, that U.S. District Court Judge Emmet Sullivan overstepped his authority in second-guessing the prosecutors' decision.

Judge Robert Wilkins, an Obama appointee, dissented from the decision, saying he would grant Sullivan the space to explore the DOJ's request for dismissal.

Gee. Go figure.

I said like a month ago, the gov just needs to cut him like $20 mil right now to go away and shut up and everyone laughed at that as nominal.

Hopefully the Flynn book is 90% written and it ready to be published in a month.

They'll try and ask for an en banc review of the entire DC Circuit Court of Appeals. Susan Hennessy from Lawfare is already yapping about it on Twitter.

I'm not sure who would even have standing to make the request. If Sullivan somehow tried he'd be risking an even larger beat down.

The amicus was a delay tactic by Lawfare. It was their last play in this case with the sole goal of keeping Flynn quiet.

It was a delay tactic for sure, but I’m not convinced the objective was silence. He’s been talking through his attorney for over a year.

I think they were more interested in using Flynn to continue to “prove” Trump is corrupt and his admin is criminal for November.

Now they can’t.

I kind of appreciate his fast talking. When I listen to Bongino I have to put the him on 1.5X because he talks so slow it's aggravating.

I like Bongino, but his mic has got to be waterproof. You can hear him spitting into that thing for an hour straight

If the prosecution and the defendant are both happy with the decision, who has standing to request such a review?

Yeah, and don't be surprised if Sullivan asks for some sort of en banc hearing. Remember, this is the specific court for which Harry Reid brought out the nuclear option so Odumbf*ck could pack this court with the most far left wing politicized whackjobs he could find.

Who?

Sullivan is not a fricking party.

Amici cannot appeal.

Someone needs to tell them that it's over. Just take the L and go home.

The Chief Judge Sri Srivinsian is the one who wrote Fokker which is controlling precedent in the DC Circuit and he will not overrule himself just to keep Flynn under wraps for a few fleeting more months.

Is it really "unusual" to drop charges on a defendant?

that's what i'm saying. the 2 actual parties to the litigation have been in agreement before Sullivan turned this into a circus. i don't think a judge is a party who has standing to appeal, so i don't see who can request an en banc review

In the filing to "hire" his attorney, Sullivan listed himself as one of the "parties." So, don't be surprised if Sullivan himself asks for an en banc review.

And, as I posted above, this court is filled with Odumbf*ck politicized nutjob appointments who will do anything to support the DNC.

ETA: I believe it was Gleason's filing to make an appearance and Sullivan was listed as the party. Unfortunately, I can't find it doing a quick Google search.

ETA - Part Deux: Found it (it was Wilkinson's entry) --

Nobody, but that won't stop Sullivan or maybe even Gleeson from seeking review. These people are scared shitless of Flynn talking.

There is some bitch-slapping going on from the excerpts that I have read. They also took some time to slap Gleason around a bit.

Flynn to a high cabinet position pronto.

I hope that Flynn goes to a microphone. But like us he may be so used to not being allowed to speak w/o banishment, shadow banning and ridicule.
