AFT Pistol Brace rule creates a trap for lawful gun owners

TLDW: DO NOT COMPLY
the new regulation requires you to register pistol braced firearms. you send photos and documents pending review. If your registry is denied or automatically denied after the total 88 day review period they will "take enforcement action"

The West Virginia vs. EPA SCOTUS decision took away such power from gooberment agencies.
I would not pay attention to anything from the ATF or other gooberment agency mandates going forward.

Seems like a 5th Amendment violation.

I believe I read that the 88 days doesnt start until your form is on the top of the pile and they start reviewing it.
Not to say its not a trap...

Is it different than other form 1s under this new grace period?
You could remove the brace and send it to someone without any short barrels, send in a form one (request to build) and if not approved you have nothing illegal. If approved buddy sends it back to you and you slap it on

Will simply removing “get rid of” the brace be legal?
Can’t seem to find that answer

Yes. It will be a pistol if there is no stock, the brace not being a stock is why it was able to be classified as a pistol before
It can’t be on your property though, if you have the material to make it illegal it must be registered. So no spare stocks either that aren’t attached to other guns

I think if you take the brace off and get rid of it then you are good to go. I think if you have the brace still and keep it say at your house with the pistol they can get you with intent of some sort.
I am not a lawyer, I just read a long thread on reddit under r/nfa
IMO it will almost certainly get over ruled like the bump stocks. I think they know that too. I think they just want to get as many guns on a master list as possible. I'd bet most "pistols" are in a super scary AR automatic weapon of war format. So they will have a big ol list if they ever do push a ban through. I already have some NFA items so im already on the list

Is there really anyone who is dumb enough to do that?
The short answer is yes. If the last two elections haven't proven we have an epidemic of stupidity in this country I don't know what to tell you.

Yep no way they can process 10’s of millions of new applications in that time frame hell you would be pressed to get an sbr form 1 back that quick now.

What’s crazy is how there could be millions of people that are totally unaware of this change. They bought a pistol brace AR legally, shot it a few times, and now it sits. They are not entrenched in firearm hobbies, outdoors, hunting, etc that may inform them that f this new change
Later down the road they decide to go shooting at a families property during a bbq. They get pulled over for a simple traffic violation and boom. The SBR is now the focus of the stop and pops is in jail for owning a non registered SBR.
bullshite

Does the micro roni fall under these new rules?
Edit: apparently it does. This is from their description. How does owning a piece of plastic be considered an SBR?

If its the version that has a brace...then yes.

No. Pistol brace was added to short barreled rifles as a work around to avoid having to register SBR. If you remove it then you have a SBR and still requires registration. Unless the brace is on a handgun, then removing it will make gun legal. It’s all regarded as frick and designed to turn legal gun owners into criminals
The bottom 2 on the left side are now illegal due to having a pistol brace. It’s considered the same as a short barreled rifle on the right with a fixed stock

I am not so sure about this one. I think if you remove the brace and remove it from the location you keep you gun then its ok.
