Making a trip in a few weeks and was wondering about the gun laws of Alabama (and I guess MS too since I’m passing through). Am I permitted to have a pistol in my vehicle while making this trip? I am lawfully allowed to carry in LA (never been in trouble with the law), but I do not have a conceal carry permit

Sorry, I know it’s probably a stupid question but I just want to be sure

Pretty sure you have to have a CCL to have a loaded gun in a vehicle in Bama.

In Alabama, if you don't have a pistol permit (CCW), you will need to unload your pistol to transport it. Also has to be out of reach of all passengers.

Unload it. Put a trigger lock or something in it and put it in a suitcase.

PITA but if you breakdown on the side of the interstate or whatever you still have it with you.

Not to mention that some sheriff got caught handing out pistol permits like candy so now we have to go through a NICS check even if you have a pistol permit.

You are allowed by law to have a loaded weapon in your vehicle. That vehicle in the laws eyes is considered like your house. I’ve been stopped several times and as long as I was upfront with the officer and let them knownI had a loaded gun (without a conceal carry permit) they respected me for it and let me be.

This is another great reason to have a CCW.

Yep. Open carry is legal in Alabama, so under current law you can walk around with a piece on your hip with no permit but the second you sit in a car with it you're breaking the law unless you separate and lock the gun and ammo. Asinine.

Let that lapse as well. Still carry concealed, never had an issue.

Thanks, this is the actual code:

quote:

Except as otherwise prohibited by law. A person legally permitted to possess a pistol, but
who does not possess a valid concealed weapon permit, may possess an unloaded pistol in his or her motor vehicle if the pistol is locked in a compartment or container that is in or affixed securely to the vehicle and out of reach of the driver and any passenger in the vehicle.
____________________________

A person may lawfully transport a firearm, including a handgun, from one state in which they are legal to possess
to another state without a permit as required under Alabama law, provided the following conditions are met:
? The firearm is unloaded.
? Neither the firearm nor any ammunition being transported is readily accessible or is directly accessible
from the passenger compartment of such transporting vehicle.
? In case of a vehicle without a compartment separate from the driver's compartment, the firearm and
ammunition shall be in a locked container other than the glove box or console. Title 18 U.S.C. section 926A

Just put the damn thing in your truck however you would normally put it. Is it clearly visible from standing outside the vehicle, which would be a stupid idea by the way in any state.
Do you plan on getting pulled over? If you do get pulled over, do you plan on giving the officer a reason to search your car? Just act normal. You get pulled over, you get a ticket for speeding or whatever and you go on about your day. There's no reason anyone has to know you have a loaded gun in your truck. It's there for your protection if needed, and that's it, so unless you need it, no one will ever know it's there, unless you're a drug dealing loser that gives cops a reason to search your vehicle.

Good luck if you get pulled over in certain counties.

I had one guy call me recently wanting to sign up for my CCW class. He told me the following:

He is a Louisiana resident, was pulled over in Alabama, had loaded handgun (SIG) on his person, was given a citation and the cop kept his pistol. He paid his fine in court, but did not get his pistol back.

The judge told him that he could not get his pistol until he provided proof of having a CCW permit issued by a state that has reciprocity with Alabama. So he called me, when he returned home, to sign up for a class.

His problem: After talking further, he mentioned that he has a DWI conviction on his record. I had to be the one to inform him that he can't get a CCW permit in Louisiana until five years after the DWI conviction.

Meanwhile his SIG is rusting away somewhere in an Alabama evidence locker.
