How would that flimsy low to the ground gate decapitate somebody? A vehicle would blast right through it.

If ever a settlement for mental anguish is deserved it’s for this. Can’t imagine.

Not to mention, the speed limit sign right next to the gate says 15 mph. That gate must have been flying. Amirite?

The only way is if one side of the gate swung open way past the closed position and the car ran into the end of it and the end of the gate pierced the front of the car like a jousting competition.

In that scenario how would you not stop and allow the vehicle to run through the end of the gate far enough for it to run through your wife?

The guy was either driving way too fast or he was on his phone trying to post a picture they just took onto Instagram and not paying attention.

Story said the car impaled on the gate, so I think you’re close.

The gate swung out into the road right as he was passing it and he drove into it, piercing it through the windshield. Freak tragic.

A sad situation but for $270 MM, I’m sure somehow they’ll just keep forging ahead.

They must have been driving a Prius, cause any car with normal clearance would’ve taken that gate in the engine block

a settlement

A verbal exchange I heard between a potential juror and a plaintiffs attorney during selection. They were seeking $40 million for a client who had his arm injured (eventually amputated) from a workplace accident.

Attorney: So you have stated that you think $40 million is excessive? Well how much is fair Sir? How much would you take to let me chop your arm off?

Potential Juror: I don’t know. But a lot less than $40 Million.

Attorney: Dismiss for cause your Honor?

Judge: Nope. You asked the question.

Let’s not lose our heads about this. Still lots of info to be discovered before we can make any judgements. It’ll give you a headache just thinking about it.

Something’s not adding up. It shouldn’t be wrongful death when it could have been prevented with the slightest of caution
