I was at a motorcycle rally up in Lake Lure, N.C. and a group of us were at a bar talking about the kind of night life in our home cities.

When I said there were bars in the N.O. are that are open 24/7 and we have a bunch of drive-thru Daiquiri shops, they were shocked beyond belief. A lot of the folks at the rallies are from small town USA and their sidewalks roll up around midnight, or not long after.

Hell I know of a daiquiri shop where you can get not just a daiquiri in the drive through but you can even get a cold longneck.

If the straw is taped to the top of the cup or they hand you the straw then the daiquiri, it's not considered an open container, that's how they can have a drive thru.

What about liquor stores, restaurants, casinos and people having a drink in private residences?

Hopefully you know it's legal to drink and drive. It's illegal to drive intoxicated. There's a difference. I can go to a daiquiri shop and have a small and safely drive home. I can go to a steak restaurant and have a glass or two of wine and legally be under the limit and able to drive.

This will blow your mind. I can have an open container while driving in Mississippi.

With regard to auto insurance in Louisiana, statistically, yes daquiri shops are a much lesser issue than what I outlined in my original post.

I drove by a beach once, and noticed a lot of people in the water. I bet a lot of them didn't wait a half hour after eating.

There wasn't even a lifeguard, so they were very reckless about cramps.

There is no rule that the top has to be taped. That’s the old “manufacturer” rule where the drink had to have a “manufacturer seal.” Class A establishments were determined to not be considered manufacturers just because they mixed drinks.

The rules are as I posted:
Must have lid
Cannot have straw in it
Contents cannot be partially empty/consumed.

I didn't say that the top has to be taped. I said that if the shop tapes the straw to the top, it's not considered an open container. From what I've seen, most hand you the daiquiri then a wrapped straw.

Tape means nothing. It’s still not a rule for opened container. Daiquiri shops used to do that because they thought it was a technical way to get around it. It’s not. Neither is unopened straw.

In some places it’s also illegal to be drunk in public, so even if those folks were taking a train or bus, they could still get public intoxication charges.
