The newsletter as mentioned below may be a good way to guilt them. But the bottom line is if they do not believe the HOA will do anything, they won't just suddenly start paying.

Start the legal process, with collections notices, threats to place a lien on their property and take them to small claims course. Don't start the process because there may be a 2-year limit, make them argue this to the judge.

How about everyone stop paying their fees and you take back your freedom that you gave up when you allowed someone else to decide what to do on your property.

no, if you live in an hoa neighborhood and signed the contract to abide by the rules, do it. i did it because i don't' want some shite neighbors to paint their house pink and park a rusted out beater on the front lawn. you can want that, that's fine, and you should absolutely exercise your right to not live in an HOA neighborhood. but if you DO agree to it, you are responsible for abiding by the rules...

HOA fees are the price some pay to keep trashy neighbors from being trashy. Trashy neighbors being trashy lowers property values according to empirical data.

Everyone who owns a home in a neighborhood with an HOA moved there willingly. People like you who go back on their word and do not fulfill obligations are the reason HOAs are necessary.

Sounds like your HOA is run by volunteer residents who are incapable of handling the issue....either because they don't have the time, don't care to put in the effort, or they're afraid to ruffle the feathers of some of their fellow neighbors and friends by threatening them with filing a lien or turning them over to a collections agency.

If your HOA's volunteer board can't handle it, then they need to hire a professional HOA management company that'll handle the dirty work. A management company will be motivated to make sure everyone is paying their dues because otherwise how is the management company going to get paid?

Nah, I purposely decided not live in a neighborhood with an HOA....my property value is just fine. I love the excuses that people use for the HOA....oh someone is going to be a shade tree mechanic in a neighborhood of homes that are worth 400K or they won't cut their grass, etc.

My neighborhood does not have it, and I don't wrestle with any of those issues. Never have.

All of it depends on how the HOA agreement is set up. A ton, if not most, of them are voluntary by design and therefore no one has to pay a cent.

It’s ironic that you say “let people live” then tell them they shouldn’t care about things they care about. I care about not loving people that do trashy things. Therefore I freely agreed to the rules in my neighborhood that regulates things. Why do you care? Let me live.

We live on 5 acre lots and have 43 homes in our HOA. The past 1.5 yrs has been a nightmare with the people who sat on the board for decades. They all got pissed when people revolted over them trying to add a bunch of crap to the bylaws...basically a bunch of mentally ill karen no lifers that have nothing to do but get in your business.

They all quit the board and the new board had a new set of people that basically want to leave everyone alone. The old board did all kinda crazy stuff to harass the new board. The past year the new board has basically been collected signatures to disband the HOA without the karens knowing. We finally got enough people, but it was a huge pain.

There were about 8 homes that haven't paid dues in many years and they didn't want to sign anything to disband because that would imply they were members and they really didn't recognize the HOA. The old boards also never filed taxes since 1968 lmao. I was like do you guys really want to inform the IRS, who don't know that we exist, that we haven't filed ever?! Some really braindead people on this planet.

Anyways, our meeting is in 2 weeks where the karens and chads find out they are being stripped of the only thing they live for. It will be a crazy meeting and hoping it doesn't turn into a shootout

Property lien.....but start with a letter from a law firm stating the lien will be next step.....


EDIT: depends on the state, but in louisiana you just need to re-lien the property every 2 years. cost of the lien filing is rolled into the delinquent fees to be liened as well as late fees, and other legal fees.

BUT, make sure to read your subdivisions Covenant Agreement and any passed amendments since it was set up.

Alos, in Louisiana you can start a HOA induced foreclosure if the arrears pile up....

The HOA is gonna have to spend HOA money to legal cause this to happen.

And the more homeowners that dig their heels in and hold, the more HOA money y’all will spend on legal fees.

More or less, the homeowners ultimately hold the power here as long as they are willing to push back and say nah, I’m good, I’m not paying
