I was watching "Betting on Zero" on Netflix. It's about the company Herbalife. Is being a MLM a loophole for Pyramid Scheme?

There was a statement someone made that said "we are not a pyramid scheme, we are a mid-level marketing company". Is there a legal difference? Pyramid schemes are illegal, so what makes these companies be able to keep running as a legit company?

The main difference is that a pyramid scheme is illegal and Multi-Level Marketing isn't.

The 77% of Herbalife sellers who make less than 1,000$ a year before expenses are not bad people just mislead and under educated.
The 15-50 people making millions a year are evil.
I am watching the documentary and last year I read a book exposing Amway.

No, I know the difference between both, Ponzi schemes are when people convince people to invest, then use the money people invested to pay the other people hoping they will keep their money in while they usually use the money to finance a lavish lifestyle.

MLM requires the sale of product. Not just a straight “investment” like a ponzi.
