Self-defense
You can't gun down someone just because they shoved you, and you especially can't unload on them as they're trying to escape.
This guy's life was never in danger and no jury will believe it ever was.

Just because the guy turns around doesn’t mean he isn’t still a threat
He wasn't armed and he was retreating. What was he a threat against?

That's not homicide?
Didn't the first post say he's charged with 1st degree murder?

Depends on where you live, but in Texas, if a guy comes on my property and physically attacks me, I can shoot.
He spun around because he got shot. There isn’t a significant pause in the shots that would suggest the shooter realized he was retreating.
Cussing at him after he was shot is inconsequential. Adrenaline rush. No impact on the event.

Who backs up to confront someone that yells to slow down?
Have done it on two occasions. Both to jerks in the neighborhood who complain about everything. Was speeding neither time. You can't tell the difference in 25 and 30, hilarious to think you can. One of them was a dude who threw a tennis ball in front of my daughters truck to try and make her stop suddenly. He was a real piece of work.
Always carrying though so wasn't worried.

It happens quickly, but as the shooter says "Get away, motherfricker" the dude is saying something at the same time. So for example, if he was saying "I'm getting my gun and shooting you" the shooter then reacts and shoots him immediately. Like half a second after he turns around to casually walk back to his car. That's what it looks like happened, but it's hard to know since we can't tell exactly what was being said. I suspect they may be able to clear up the audio and get the exact exchange with some technology.
Interested to see where this one ends up landing.

He's already been charged.
If you read the gruesome story on page 2 about the shooter's brother, don't see much sympathy coming his way. One of the most notorious cases ever in New Mexico.

I saw it. But that shouldn't have bearing on this dude's case.
And I know he's been charged. I'm saying I'm interested to see what comes from the case/trial.
What state was this in?

I wonder what they’re going to do with that Scout. Looks pretty nice.

Yuup, it looks bad for the shooter. But if someone yells at you on the street like that, never go back. Best way to deescalate the situation is to keep on going, too many crazy folks out there.

Him cursing at the guy after shooting him, waiting to call 911, moving the Scout. Got some problems for defense.
Not sure where. Let me search...

So preventable on so many levels. Deceased could have kept driving and live to see another day, killer could have kept his fricking mouth shut and live the rest of his life a free man.
I say this logic all the time....especially to people on bikes. You could be absolutely in the right but still be wrong because you're dead. Always blows my mind when people on motorcycles get road rage because of a dipshit in a car. You're the one unprotected by a metal frame and you never know who is inside that car.

New Mexico.
Joseph Gonzales is Seen in Newly Obtained Video Shooting a man for speeding on "his f***ing street"
Gonzales does NOT look upset at all in his booking photo.

We obtained the 911 phone calls, security camera, and lapel footage of the incident and one of the callers was Joseph Gonzales. He tells the dispatcher, "Shots have been fired and there is a man down. I think he is dead." The other two 911 callers are the owners of the security camera and live directly across the street.

The victim was about to become a first-time father. Baby shower was coming up.
This about the accused as well:
quote:
Joseph Gonzales was most recently an important witness for the defense in the trial of Fabian Gonzales, tied to the 2016 killing of Victoria Martens. Joseph is Fabian Gonzales’ older brother. Joseph Gonzales has never been charged or associated with the Victoria Martens case. He was only interviewed as a witness during the investigation.

Well I’m glad to know you feel that speeding doesn’t constitute murder.
