The witness reported that "despite those warnings," DiGuglielmo continued to approach, and video showed him "aggressively approach" Payne, according to the memo.

Not sure how they could make a case. He was behaving aggressively, she retreated and gave him a chance to back off, and he still came at her.

I’d think her going to get her firearm and exiting her vehicle with it would negate not being charged when she could have driven off. Has she been inside of her car and he approach then yes. Not taking his side, he was an idiot.

I remember people in the original thread confused as to why she shot him. But he had that shite coming snd very much was the aggressor.

Going by the video I saw, it's the right call.
The guy was being very confrontational and wouldn't let up, even after he saw her with the gun and her doing her best to avoid the situation.

To be honest this one is a gray area. At one point where she'd drawn her weapon she turned her back to him. Hard to prove fear of bodily harm.
On his part, when somebody points a gun at you, your point is mute. Mouth should be too. If they give you the option to walk, take it.
Can't hear what's going on, cannot tell if she is continuing to provoke him or not. Or if she's just warning him to back off and leave her alone.
Quick note: Has no bearing on the shooting, but here in MO this woman would have been in jail. (Unless it was KC or STL). Substantial history of repeat offender driving without a license, dating all the way back to 2014. Repeat history of not following through on fine payments, and defaulting her cases. Repeat here results in jail after strike 3, minimum 1 year.
