As specific as you can be, why should the victim be shown in a negative light? What does is matter that he was posing with guns online?
——
The guy could be a serial killer, not sure what any of that has to do with this specific death.

I've met the victim before at a church event and we had some mutual friends on Facebook that led me to this story. This sucks, world lost a good person today for absolutely no reason.

I would be willing to bet money the officer does time for this, but don't let this get in the way of your "cops get away with murder all the time" circle jerk.
Did a police officer in the Dallas area just get convicted of killing a teen that was of no threat to him?

If she does, it will be something ridiculous like 1 YEAR for KILLING an innocent human being.
And then, after everyone has moved on, she will get out early on probation/house arrest after six months on good behavior.

Yeah just like all the other bogus posts in this thread about no blood being drawn or no charges being filed. It’s all bullshite you all make up in your heads to let yourselves get hyped up over.
That’s the problem with everything nowadays, people just believe the shite in their heads instead of having any rational thought process.

She definitely intended to shoot the guy. Not sure how the “self defense” defense will go since she wasn’t in her own place and the guy simply opened the door.
You have to meet one of these requirements for capital murder:
Sec. 19.03. CAPITAL MURDER. (a) A person commits an offense if the person commits murder as defined under Section 19.02(b)(1) and:
(1) the person murders a peace officer or fireman who is acting in the lawful discharge of an official duty and who the person knows is a peace officer or fireman; --- No
(2) the person intentionally commits the murder in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat under Section 22.07(a)(1), (3), (4), (5), or (6); --- No
(3) the person commits the murder for remuneration or the promise of remuneration or employs another to commit the murder for remuneration or the promise of remuneration; --- No
(4) the person commits the murder while escaping or attempting to escape from a penal institution; --- No
(5) the person, while incarcerated in a penal institution, murders another: ---- No
(A) who is employed in the operation of the penal institution; or --- No
(B) with the intent to establish, maintain, or participate in a combination or in the profits of a combination; --- No
(6) the person:
(A) while incarcerated for an offense under this section or Section 19.02, murders another; or --- No
(B) while serving a sentence of life imprisonment or a term of 99 years for an offense under Section 20.04, 22.021, or 29.03, murders another; --- No
(7) the person murders more than one person: --- No
(A) during the same criminal transaction; or --- No
(B) during different criminal transactions but the murders are committed pursuant to the same scheme or course of conduct; -- No
(8) the person murders an individual under 10 years of age; or --- No
(9) the person murders another person in retaliation for or on account of the service or status of the other person as a judge or justice of the supreme court, the court of criminal appeals, a court of appeals, a district court, a criminal district court, a constitutional county court, a statutory county court, a justice court, or a municipal court. --- No
(b) An offense under this section is a capital felony.
(c) If the jury or, when authorized by law, the judge does not find beyond a reasonable doubt that the defendant is guilty of an offense under this section, he may be convicted of murder or of any other lesser included offense.

Manslaughter is what actually fits though...
Sec. 19.04. MANSLAUGHTER. (a) A person commits an offense if he recklessly causes the death of an individual.

Wouldn’t most people be arrested for this?
Pretty if I accidentally tried to go into my neighbors’ home and shot them I would be arrested, or nah?
Good article on heavy with facts LINK

But how did cop get in? Who leaves their door unlocked in a shitty apartment?
It says she had trouble opening it and her key is still in the lock.. and that he went to open to door, I suppose after hearing the commotion.
It also sounds like they want to keep everything tight lipped.
With that said, No crime leaving a door unlocked, my goodness. Maybe you are leaving soon? Who knows.
It’s sad this is a type of person who can make life and death decisions by using deadly force. Some people really have poor awareness and decision making.. She needs to go to prison for a very long time. It’s heartbreaking what this idiot did.

That’s awful. She needs to serve much more time for this crap. I agree with you but hope we are wrong.

yeah, but it'd be hard to argue against felony murder here. trespassing while armed is a felony in texas.

Statute?
I'm only seeing:
(d) An offense under this section is:
(1) a Class B misdemeanor, except as provided by Subdivisions (2) and (3);
(2) a Class C misdemeanor, except as provided by Subdivision (3), if the offense is committed:
(A) on agricultural land and within 100 feet of the boundary of the land; ?or
(B) on residential land and within 100 feet of a protected freshwater area; ?and
(3) a Class A misdemeanor if:
(A) the offense is committed:
(i) in a habitation or a shelter center;
(ii) on a Superfund site; ?or
(iii) on or in a critical infrastructure facility; ?or
(B) the person carries a deadly weapon during the commission of the offense

You have no clue if any of what you posted is true.
We have one side of the story here and I have serious doubts in its veracity.
This just does not pass the sniff test and I am willing to bet there is some other vector linking these two.

Let me clarify my post for you then.
I am only speaking to what has been reported and the requirements for the charges.
As of now with the info we have...manslaughter looks to be the appropriate charge.
If new info arises then that could open it up for Murder or Capital murder charges. But new info would still have to meet the requirements I posted.

you may want to check out burglary code also found in chapter 30. Entering a house armed with intent to commit any felony. You don't force your way into an apartment with a gun drawn if you aren't intending on assaulting someone with it.

What felony did she intend to commit? You must prove criminal intent with burglary.
Its on the state to prove her intent...so they have to have evidence of that intent.
That is the problem...overcoming the statement that she entered by mistake which only fits trespassing which is not a felony.

Did she force entry with her gun drawn? Or is it possible she is just stupid and walked into the wrong apartment?
