One of the most famous IIED cases that was successful and went all the Way to the US Supreme Ct was the people that picketed at dead soldier’s funerals with offensive signs. Parents sued and Protesters were found guilty of IIED. It was overturned because of first amendment protest protections. But without that, the verdict would stand. Laundries wouldn’t have that first amendment defense here.
I think that IIED case sets a precedent that you don’t frick with dead kid’s parents.

Maybe I’m jaded by years of either corrupt or dumb judges not dismissing cases for failure to state a claim. But I’d say the vast majority of judges wouldn’t dismiss. I guarantee there’s a plaintiffs attorney willing to take a shot.

In a potential civil case like this, looking back at the investigation that was going on at the time, how would the fifth amendment come into play with the parents?
In a civil case that would allege IIED that would be going after his parents for not talking, how would they be liable for something like that if they stayed quiet because they legitimately believed anything they said could possibly incriminate them?
Does that question make sense?
It seems like that would be saying that you are expected to incriminate yourself in a situation like that or face a potential lawsuit that could very well bankrupt you.

It not just that.. the people in here give uninformed opinions and hypotheticals on partial information that may or may not be completely accurate at the time and they stand on their soapboxes and preach the shite like it’s gospel… I get that it’s a message board and it’s perfectly fine to speculate but some of y’all really need to take a step back and understand that at the end of the day, we (the general public) don’t really know shite about what exactly happened or what’s going on ‘behind the scenes’

laundrie family attorney discusses what happened today, and other aspects of the case...he states that the FBI was notified on 9/13 that BL didn't return from hiking...this was 2 days after GP was reported missing, the FBI was not even involved at that point...NPPD was not notified until 9/17...

It makes a lot of sense and is definitely an interesting question.
Invoking the 5th Amendment doesn’t protect you from civil liability. If you don’t talk because it may implicate you in a criminal matter, that’s your right under the fifth amendment. But you suffer whatever consequences that brings on the civil side.
Say I sell my house in a state that requires you to disclose if a murder occurred (I think a few states require this), and I don’t because I don’t want to incriminate myself for a murder that I committed in the house..
The 5th amendment doesn’t protect me from a suit by a buyer that later finds out you murdered your wife there. Your reason for not sharing the information doesn’t matter.
I think since IIED requires outrageous conduct, the Laundrie lawyer would argue that not talking when implicated in a crime is reasonable, taking you out of the IIED outrageous conduct arena. But, if I represented the Patito family I would say the fact that you have to invoke the 5th shows that you engaged in outrageous conduct not acceptable in society (aka committed a crime). It’s a double edged sword. Who knows how that would shake out.
