Ultimate "Piss You Off" Story for Today

Colorado. A family in their backyard at a toddler's birthday party. Next door lives a Deputy K9 handler. The K9 gets loose, jumps the fence, grabs a hold of the little girl, breaks her femur, disfigures her, and attacks the dad who tried to help. (Dad said he could hear the dog crushing his daughter's bones). Both little girl and dad were in hospital. Total medical bills were about 300k.
DA prosecuted the deputy for "harboring dangerous dog." The Deputy invoked qualified immunity and said since he was cleaning his dog's pen at the time, this constituted "official duties." The jury bought it and he walked.
The family tried to get an attorney for a civil suit, but every attorney rejected the case saying it's impossible to win because of how well the law protects negligent Cops. The dad also said the Department promised they would "make it right" but lied and have done nothing. They won't even reply to the media for comment. Total POS department.

Beyond the fact that claiming this as official duties is nonsense...If a K9 officer WAS actually out patrolling, and the dog got out of the car and attacked an innocent bystander, wouldn't the department be liable for damages???
I don't understand how they got to 1) say it was official duties for qualified immunity and 2) not be liable if it was official duties

Yea, someone is at least civilly liable. It's actually better that he was performing "official" duties, because that should put the city on hook. A K9 is a police officer. This should be no different than if a cop personally did this.

Yea, someone is at least civilly liable. It's actually better that he was performing "official" duties, because that should put the city on hook. A K9 is a police officer. This should be no different than if a cop personally did this.

I can understand why the deputy wasn't charged, but if it was official duties the police dept. should be liable.

I’m no lawyer, but if a K9 is considered to an officer like any other cop, what would be the legal, both criminal and civil, consequences if a human cop had jumped the fence and attached this little girl causing her serious bodily injury?
There has to be some liability on the part of this city and its police department of some sort, right?

My question is why did the dog become aggressive? I thought most K9 police dogs are pretty chill until instructed otherwise.

I will have to think about the criminal charges….but I don’t believe for a second that they couldn’t find an attorney to handle a civil case for them….
