Absolutely.

If a cop performs an action and "qualified immunity" is upheld. It makes it practically impossible to successfully sue the cop civilly. No attorney is going to want that case.

HOWEVER, the dog jumped the fence and attacked the girl. Not the cop. And the dog is the department's property. And I've never heard of a K9 claiming qualified immunity.

So I don't know why the ambulance chasers would be so hesitant to file suit.

All I know is if this was random neighbor's dog... the random neighbor would be arrested, sued, and the dog would be euthanized. So I suppose the K9 does get some kind of "immunity".

There was a case in north LA where a lady was jogging down the street and a cop dog that was out of its kennel attacked her and chewed her up pretty good. She sued. The city settled.

Absolute bullshite. That dog shouldn't be attacking people without a command. If the dipshit deputy can't be a responsible partner, he ought not have it at his home.

That dog would enjoy a nice antifreeze hamburger. But this story is probably half true and half BS rage bait.
