This town has a serious character problem.
There should never have been a lawsuit - the town should have arrived with ample money to cover the medical needs and extra for the pain and suffering without hiding behind immunity.
They should do the right thing without being forced by a court.

The story as it is told does not pass the smell test.
Something is off.
1) the police are liable for the actions of its officers (including k9)
2) home insurance handles these claims on behalf of the homeowner. The municipality and the owner of the dog are not involved at all.
3) no attorney is going to turn down an opportunity to sue anyone after a dog bites a child.
Put that shite in front of a jury and you are getting a maximum award.

I work near them. There are bad apples and they are still dogs/animals. In fact, the incessant barking of one near my workspace almost completely turned me off to dogs in general.

I would think that would happen only if the victims had reason to believe the dog was a cop acting in a law enforcement capacity.
The cop knew he was performing a law enforcement duty by caring for the dog, but that doesn’t mean the moment carries forward to others that the officer never intended to impact.

I agree that raking care of the dog is a duty but it shouldn't bring immunity. That dog should be trained well enough to follow commands

I'm not one to defend the nutcases in Colorado, but giving a COP qualified immunity on his day off when his dog attacks a neighbor's child seems more of a conservative jury mistake than a liberal one.
