Unlawful shex or any other penetration of another person by a reproductive organ, body part, or object without consent of the victim. look up forcible r8p if you'd like it to fit your narrative.

My question (and I am not blaming her at all) is why didn't she get up and leave?
How to make yourself look like an idiot with one sentence.

if she didn't give consent, it was forced
and besides, I was responding to your hypothetical with another hypothetical, not responding to the case in the OP

I mean she let him take her pants off eventually.
It's a valid question.

So you're saying a rape victim will always hold some blame either because she was ignorant or she didn't do something sooner to prevent it? Always?
Again, you're setting up a false dilemma. There are as many different scenarios as there are different snowflake designs in a snowstorm. The particulars of each determine whether or not something could have been done differently.

§42.1. Second degree rape
A. Second degree rape is rape committed when the anal, oral, or vaginal sexual intercourse is deemed to be without the lawful consent of the victim because it is committed under any one or more of the following circumstances:
(1) When the victim is prevented from resisting the act by force or threats of physical violence under circumstances where the victim reasonably believes that such resistance would not prevent the rape.
(2) When the victim is incapable of resisting or of understanding the nature of the act by reason of stupor or abnormal condition of the mind produced by a narcotic or anesthetic agent or other controlled dangerous substance administered by the offender and without the knowledge of the victim.
B. Whoever commits the crime of second degree rape shall be imprisoned at hard labor for not less than five nor more than forty years. At least two years of the sentence imposed shall be without benefit of probation, parole, or suspension of sentence.
C. For all purposes, "forcible rape" and "second degree rape" mean the offense defined by the provisions of this Section and any reference to the crime of forcible rape is the same as a reference to the crime of second degree rape. Any act in violation of the provisions of this Section committed on or after August 1, 2015, shall be referred to as "second degree rape".
Second degree rape = forcible rape, moron.

This woman was forcibly raped and half the OT wants to know why she didn't simply get up and leave. Par for the course.

Because there are a lot of dumb people who post here.

We have an obvious case here, but somehow people are still questioning the girl and defending the guy.
Do we? What did he admit to? Did you hear it or read the transcript of the confession? "I'm sorry you didn't have a great time" or "I'm sorry you weren't into me as much as I was into you" is a far cry from "I am sorry I raped you" Or having her say on a controlled call, "You raped me!" and he respond, "I'm sorry you feel this way" Who is making the claim he confessed?
As far as this nonsense about how the onus shouldn't be on her. You're goddamned right the onus should be on her! She's accusing him of something that could be a potential life felony. If our criminal justice system means anything, the onus should be squarely on her.
Always amazes me that the ones that advocate for women's issues have such low opinions of women. In their patronizing view, women are such emotionally fragile or underdeveloped little creatures that we couldn't dare make them answer questions of an incident that may take the freedoms away from another individual. So don't dare ask. If you do, you're just a mysoginistic cretin.

I guess I don't understand how an answer to the question would change something. If we assume she didn't try to leave, is there a reasonable answer that would matter?
You get the feeling that the OP and others would tell her she didn't do enough to prevent the rape, which is 100% victim blaming.

Again, you're setting up a false dilemma
Girls hangs out with guy and wants to be physical but no sex. He forces himself on her after she says no repeatedly. He admits to it and tells her not to report it. She does anyway to multiple people. Why is the question "how could she have prevented it"?
Do you also question the people who get mugged in the French Quarter at 9 PM?
quote:You're dancing around actually saying a victim is always partially responsible for being a victim. When bad things happen, we can always go back and look at a million different scenarios that could have prevented it. The truth of it is that we can't always see bad things coming. Why would she think this guy she's known for years would do something like this? And by the time it happens, it's too late. Maybe she was warned about rape situations in terms of parties and strangers.
The particulars of each determine whether or not something could have been done differently.
