My boss constantly tries to get me to do shite a minute after I clock out (yes I work an hourly shift, yes I’m poor, idgaf), as well as tells the employees they can’t discuss their wages with other employees. Both of these things are actually ILLEGAL even in Texas.

Texas IS a right to work state. All that means is that you cannot be denied employment bc you are/are not a member of a union or labor organization. You cannot be forced to join a union in order to be employed.

Texas is also an Employment at Will state. That means either the employer or the employee can terminate employment at any time for any reason or no reason at all. You don’t have to give a reason for leaving and you’re not obligated to continue working for a period of time after you choose the leave. Likewise, the company can terminate your employment for any reason or no reason at all and aren’t obligated to give you advanced notice.

Salaried vs Hourly is determined by the Fair Labor Standards Act (FLSA) which is federal. There are specific guidelines to determine if an employee is paid hourly or by salary. Your employer does not get to choose. From my course material:

In general, an employee has to make at least $684 per week ($35,568 per year), be paid on a salary basis, and perform exempt duties that require discretion and independent judgment at least 50% of the time. Because of the FLSA, you can’t negotiate whether a job is exempt or nonexempt. Regardless of job title, it’s the duties you perform that determine your job category.

we are a small business in Texas and we have a gay employee who takes off more time and causes more drama than anybody in the company.

while i don't wish ill on him, and he does some ok things for the company, we'd be better off without him.

if my boss ever has to pull the trigger, he has a pile of documentation ready to go just for the lawsuit reason.

They’re flocking because that’s where the jobs are. They’re not flocking because they think Texas is cool and truly want to live there on that alone.

Texas gives the appearance of having its shite together but in reality it doesn’t. Texas natives love to shite on neighboring states and look down on them instead of looking in the mirror.

Yeh but most companies won't bc of law suits. They should be able to based purely on job performance but many try to establish documentation of tardiness, missing, etc before firing someone.

Find a new place to work. You have a manager up the chain who is crazy.
25 years ago I worked at a place who had a dickhead as a manager. He was Jewish and had a PHD so he thought very highly of himself.
For Christmas lunch celebration day he told people they couldn’t start heating up food until the actual lunch break time started.

At one point he also had the admin start going around with a roster in a clip board every morning to check who was at their desk at 7:00AM, which was our arrivals time.

I am not bedside. Outpatient area.

Haven’t worked the floor since Clinton was in office. ER completely in between. Sadly I would get less shite for getting coffee in the ER. Matter of fact, I never heard anything about a trip to buy water or coffee or a snack. As long as you go there and come right back it is a non issue. Until this month??
