I argued the other side yesterday, but I don't see how she can have any charges against her legally. I only see how the school has it's own right to let her go.
This however is not the same. The same would have been her leaving the cell phone at home and a kid stealing it from her house. Or her bringing the video to school and keeping it in her private purse.
I think the school has a right to say they don't want their employees having sexually explicit content, but I don't see how charges can be brought against her for the delinquency issue. Then no one can have porn outside of their house (let's say in a brown paper bag on the way home from the smut store), since a kid might dig in the bag and see it while you aren't paying attention.

Legally, which is what I was asking about, it is exactly the same. Going through someone's phone and posting their pictures, without permission, is illegal.

I agree with her facing charges. Keep your phone in a safer place and don't put nudes on it in the 1st place.

This is an odd situation. I can't believe she is being witchhunted like this...I hope the kid who did this is sued, as well as the school district that canned her.

This is one of those things that still makes me feel like I'd never work in a school system without Union representation. Because when it boils down it the school system nor the parents give a frick about you as long as they are able to wipe their hands of the scandal. If the school wouldn't discipline the kid I'd file a charge for theft (and depending on the phone, that could be a felony charge in some states). And at the first threat of firing me for photos that were stolen from the phone that was stolen out of my desk, I would have my rep in there.

No, I'm not comparing the 2 acts, but you're flatly saying that anything on her phone that is found during a theft she shouldn't be in trouble for. That's not true. We can debate this specific issue, but your blanket statement is not true at all.
