so getting something stolen off your phone is considered "contributing to the delinquency of a minor."

Makes sense

Just popped in to say I called this yesterday. The precedent you and a couple others were defending will open up this can of worms.

Of course if i remember correctly you and tangerine called that idea ludicrous. Never underestimate the stupidity of the American justice system.

I argued the other side yesterday, but I don't see how she can have any charges against her legally. I only see how the school has it's own right to let her go.

quote:

A kid breaks into your house and finds a personal video of you and your lady/man doing the deed. Would you be charged then?

This however is not the same. The same would have been her leaving the cell phone at home and a kid stealing it from her house. Or her bringing the video to school and keeping it in her private purse.

I think the school has a right to say they don't want their employees having sexually explicit content, but I don't see how charges can be brought against her for the delinquency issue. Then no one can have porn outside of their house (let's say in a brown paper bag on the way home from the smut store), since a kid might dig in the bag and see it while you aren't paying attention.

Well yea, that's certainly up for debate.
No it isn't. What is on your phone is no ones business. If she had nothing but donkey scat porn on her phone it wouldn't make a difference as long as she isn't looking at it while at school. A teacher isn't responsible for a thief.

Let's just imagine that instead of his teacher he did this to one of his 16 year old classmates. Kid would be fricked for life.
Maybe not for life, but he should be screwed for this, that's enough of a violation.

Except the article yesterday stated that she hadn't broken any school policies by having the photos on her personal phone. (If I am remembering correctly...)
You may be correct, but it could also be semantics on her part. She said there's no policy against inappropriate material on a cell phone specifically. But if there's a policy, and I'd imagine there is, about not having inappropriate material with you at school(a more generic policy), then that's where the debate lies.

Legally, which is what I was asking about, it is exactly the same. Going through someone's phone and posting their pictures, without permission, is illegal.

Did she have any kind of security lock on her phone?
The article from yesterday's thread said she did not. Bad choice on her part.

I agree with her facing charges. Keep your phone in a safer place and don't put nudes on it in the 1st place.

Can't speak for Tangerine, but I'm 99.9% certain I didn't comment on any posts about the precedent this would set.

This is an odd situation. I can't believe she is being witchhunted like this...I hope the kid who did this is sued, as well as the school district that canned her.

So you think it's ok for her to leave her phone where a kid could get to it?????

This is one of those things that still makes me feel like I'd never work in a school system without Union representation. Because when it boils down it the school system nor the parents give a frick about you as long as they are able to wipe their hands of the scandal. If the school wouldn't discipline the kid I'd file a charge for theft (and depending on the phone, that could be a felony charge in some states). And at the first threat of firing me for photos that were stolen from the phone that was stolen out of my desk, I would have my rep in there.

frick resigning.

Ok, let's play a hypothetical to see if that still flies. What if the kid found a homemade video of her killling someone. Nobody's business? She should skate because that's her private phone?

No, I'm not comparing the 2 acts, but you're flatly saying that anything on her phone that is found during a theft she shouldn't be in trouble for. That's not true. We can debate this specific issue, but your blanket statement is not true at all.
