Donelin can make the insurance companies do anything after a storm. He agreed to all of the policy language on every. Policy written in La. you have a contract with your insurance co and he can’t change that. Just trying to get votes. Nothing to see here.
Not 100% true. Donelon has the vested authority, on behalf of carriers, to issue Emergency Rules. Not an advisory letter, not a memo, but an actual Rule. That's what he did in this case and every single one of the big players is playing by his Rule, except for State Farm.

Well we will see if anything changes. I’m an adjuster handling storm claims and no such changes have been made

Nothing will happen. Donelon's regulatory fine is capped at only $500k, and SF will gladly pay that. Then Donelon will tighten the clamps on SF's rates and factoring, and all will be forgotten in a year. The claimants/policyholders get screwed again because SF is the market leader and Donelon needs their capacity in the marketplace, for a host of depopulation companies to come into Louisiana and just piggy-back off of SF's rates - what's called a MeeToo filing.

Loss of use has to be from a named peril loss or prohibitive use. That’s with ANY insurer. You’re pissed because you didn’t read the contract you agreed to by paying premium?
Oh, frick off you smarmy little twat.
My post wasn't some pissed off rant.

So not being able to flush the toilet is an inconvenience? Your adjuster is screwing you.
I know for a fact that all insurance companies paid for Loss of Use when they was no water after Laura.

This isn’t really subjective it’s either in the policy as a covered peril or it’s not

contact some LC attorneys. They are experts by now suing State Farm from Laura and Delta.
for the record....i had SF... Took 8 different adjusters and a few nasty letters to get it all going.

Consult an attorney. Seriously. Insurance companies will do whatever they can to get out of coverage if they can. They're often relying on people just rolling over.
I'm always curious about this approach. What does the attorney get? I mean whatever I'm paying him will take away the portion of my repairs. What am I to do? Give away 33% of my claim so then I still can't rebuild my house?

I have farm bureau and they paid my roof claim really quick. I don’t even think the adjuster climbed up in the roof. Lost probably ten shingles

What do you mean by get things going? Just to get a tender or reasonable one?

Underwriters are losing at the track between the hurricanes and floods and wildfires these last five years or so. If there is anything the mafia hates, it’s losing while gambling. The house doesn’t deal well with losing.

More tort reform should do the trick. My rates have plummeted since last summer’s infinite wisdom of the legislature to benefit the insurance companies

I hounded my insurance company 5 months to replace an outside unit smashed by hail. You gotta fight fight fight, they are in the business of not paying for shite.

I dumped State Farm years ago. They have plenty of money for nfl and nba spokesmen. Not so much for claims.

quote:Loss of use is still subject to your deductible. A lot of people who had no damage and evacuated for a week until their utilities got restored and think they’re going to be saved by Jim Donelon’s emergency rule are going to be upset when they submit $2000 worth of Florida panhandle evacuation receipts and then get a denial letter from their insurer because they didn’t meet their 2% hurricane deductible.
I’m not sure how losing water for a few days would get you over your deductible, unless they waive it for loss of use
On the bright side though, hurricane deductibles are annual, not per occurrence. So at least their Ida evacuation claims will count towards the hurricane deductible in case there’s a 2nd storm this season

Never accept the first response, it took me several dozen Email exchanges, phone calls, and written responses with documentation before State Farm would pay my claim due to damage from 14 days los of power after Gustav. There goal is to get you to give up and go away.

My sister (no pics) had them during Katrina. They gave her crap over every penny. She dropped em and would never go back.

My sub was hit by a hail storm last April. I’d guess 95% of the homes got a new roof. There’s about 75 houses on my street and I’m pretty sure the only one that wasn’t changed is my neighbor who has SF. He lives directly across the street. Def at least 6-7 houses up and down the street from him were changed and same on my side the street

You understimate the sleaziness of attorneys. They want nothing more to get their foot in the door to file suit and and force mediation or a settlement so that they can collect attorneys fees that are more than the amount of the claimed loss.
What about when the adjuster low balls your damage payout? Attorneys allow you to keep your initial payout and dispute the amount. They get paid a percentage of whatever extra money they get.
I have a lot of damage at my house and was told that SF will fight me over certain things, like my ruined wooden floors from getting rained on when the roof was ripped off.

Not like their auto insurance is much better. SF just informed me that they are unable to recoup costs from a wreck I was in 6 months ago. I was at a stop light sitting and got rear ended. Guy was on his phone and never looked up. SF told me I was welcome to pursue my own claim if I wante
Did you have collision coverage. If not, SF has no basis to pursue your claim for you as they cannot subrogate for recovery of payments they did not make. Was the other party insured? Make a claim against them. If not and you were injured you may be able to make a UM claim under your policy.
