I know someone who basically pled out to the exact same scenario. She wasn't under the influence of anything and was actually going to pick up a friend who had one too many.

Exactly. She could have injected a marijuana earlier that night for all we know.

Do I think this woman would have been arrested 15 years ago....hell no.

Am I surprised she spent a night in jail today after her only crime committed was swerving her car on the road....hell no.

It is pathetic really. Also, why don't they arrest all these swerving arse texters on the interstates??? If they can legally hold a 100% sober person for DWI for 12+ hours they should be able to do the same to people that swerve texting right???

In Louisiana, if I'm not mistaken, refusal to submit to a breathalyzer results in double the amount of time your license are suspended.

I watch LivePD. People drive on suspended licenses all the time. I'm beginning to think it's the norm.

This is true and why cops can arrest you for DWI with 0 evidence

People need to learn how to handle dwi when pulled over.

First you never ever admit to the cop you were drinking no matter what.

If you fail the breathalyzer when they take you to the station wait until they have the official machine calibrated that goes on record and then demand before blowing that you want a blood test. They have to take you to the hospital for it and by that time you're sober.

Also if you're sober and pass the breathalyzer and they still detain you suspecting you're under influence of drugs demand a blood test.. If you haven't done any drugs in 24 hours you'll be clean and at that point any charge you get will be thrown out

Hell one the prosecutor still tried to prosecute for, for improper lane change because he "believed the cop"

Impossible. This would never happen in our justice system. Only the guilty go to jail and get arrested.

Have had a sitting DUI judge who's also a family member say you never do what the police ask. No road tests, no breathelyzer. Just tell them you want to speak to a lawyer before doing anything else.

In a sea of terrible advice and a poor understanding of the law, this is the most correct answer.

This has been my argument against dui. The cop only has to say you swerved or he smells it and you are in jail. In dui cases, you are guilty until proven innocent.

Yup. I was coming in late after having nothing to drink and a cop pulled me over. Said I almost hit 2 cars crossing the road when there were no other cars present. Did field tests and passed. Said he was taking me in until I insisted on a breathalyzer.
