So we got multiple offense DWI offenders getting charges reduced to 1st offense, and someone who blew ZERO spends a night in the clink. Man that's Louisiana for you.

I've passed field sobriety tests and drove away a dozen times.

Probably was on pills or something else non-alcoholic.

I knew this lady from work. It's been a while, but I would be surprised if she posts here.
She was nutty, but in a funny way. Not a lady that would be on drugs. The story on FB sounds about right.
I can picture her in my head laughing the whole time.
I also can't imagine many 60ish yr old women doing very well on one foot.
Her family is a great family and it's too bad the cops were probably too proud to admit they got one wrong.

4 pages and no one says anything about the stroke or facial nerve damage se had young. Looking through pictures shows her face has been drawn to the left many years.

Well many states allow the officer to choose breath or blood. So demanding one or another doesn't matter. If you refuse a breath and/or blood most states suspend your license for a year. Regardless if you're innocent or not. All in all very piss poor advice.
Simple answer don't drink and drive. It's really not that hard.

Unfortunately there are some crusader type cops out there who think they are saving the world and that everyone they pull over is a liar. These cops are a disgrace. There are, however people who lie about the circumstances of their traffic stop. So really hard to judge thus one.

Is there any legal recourse in a situation like this?

Can you send them a bill for the time they wasted? Could you successfully sue claiming mental anguish?

I suspect the likely answer to all this is no, but it seems like holding someone unjustly for any amount of time should have consequences for the department.

In a sea of terrible advice and a poor understanding of the law, this is the most correct answer.

As stated, this is close to being correct. I would also argue that you do not verbally respond to the officer since that then gives them the opportunity to allege that your speech is slurred or they smelled alcohol on your breath. Best thing to do is act like a rag doll -- make them pick you up and support you, do not excercise any motor skills that they could then compare against someone who was sober. Yes, you will lose license for a designated time for failing to take the breathalyzer, but you don't give them any evidence to convict.

All that being said . . . just don't drink and drive. It is so not worth the potential danger and life-long consequences. (And that doesn't have anything to do with the facts posed by the OP.)

This lady is friends with my cousin and hear she is a self righteous count sometimes. Maybe a night behind bars helped.
