St Tammany woman held overnight in jail for DWI even though she blew 0.0

This has been my argument against dui. The cop only has to say you swerved or he smells it and you are in jail. In dui cases, you are guilty until proven innocent.

This is true and why cops can arrest you for DWI with 0 evidence

I've defended clients who were clean and had to spend the night in jail. Hell one the prosecutor still tried to prosecute for, for improper lane change because he "believed the cop" (who completely lied about his observations of my client).

Not sure why but I read this preachy bitches essay on FB and she is sure to mention several times that she is "so strong" and brings up church as well. But she also blatantly admits that she told the officer she drank earlier in the night and failed the field sobriety test miserably while laughing uncontrollably throughout the police interview. What were they supposed to do with someone who admitted drinking earlier, can't pass a field sobriety test and acts strange? Let her drive off?

As for her complaint about the swerve versus the charge, she needs to go to law school or quit bitching. Illegal Lane Usage is the correct charge for what she did.

Happened to a friend of mine coming home from work on the Causeway early in the AM. Absolutely 0 to drink and not a drug user, just a bit tired. Cop said he failed the field sobriety. Brought him in, blew 0.0. Drug tests eventually all came back negative, everything dropped, but still a huge PITA. If you mess up once during the test and the cop gets it in his head that you are on something. That's it, you're wrong and he's right.

Even if she has a prescription for controlled medications the bottle says not to operate motorized vehicles while taking...

Could be a no win for her.
