Yeah.
Is it possible that we can do better than to rely on The Hayride for best legal analysis of recent judicial decisions?

What about the Democratic Governor with a law degree from LSU in regards to petition meeting legal requirements?

quote:

WHEREAS, the petition contains the legal description of the area proposed for incorporation, the statement that all the lands included in the area constitute a contiguous area, and all other information required by La. R.S. 33:1(A);

WHEREAS, it is the opinion of the governor of the state of Louisiana that the petition
proposing the incorporation of city of St. George as a municipality of the parish of
East Baton Rouge is in compliance with the provisions of R.S. 33:1, et seq.; and

WHEREAS, upon finding that the petition is in full statutory compliance with La. R.S. 33:1, et
seq.,
La. R.S. 33:3 directs the governor to call a special election to be held on the next possible date for special elections specified in La. R.S. 18:402.

NOW THEREFORE, I, JOHN BEL EDWARDS, Governor of the State of Louisiana, by
virtue of the authority vested by the Constitution and the laws of the State of Louisiana, do hereby order and direct as follows:
SECTION 1: On Saturday, October 12, 2019, a special election shall be…

BR and its elite have been throwing everything including the kitchen sink at StG incorporation. Race cards, breakaway lies, together as one lies, and so on when this is really about the elite in BR not wanting to pay more in taxes and too many of the majority in BR not being tax payers but takers. 45% of the city of BR’s discretionary spending in its General Fund comes from StG.

quote:

The loss of sales tax from the St. George area would cost Baton Rouge $48 million from its budget. From a general fund of $320 million, only about $106 million of Baton Rouge’s budget is discretionary spending. The loss of that funding to St. George would have a “substantial adverse effect” on Baton Rouge, Coady wrote.

“If St. George were to incorporate, the general fund would be further reduced by $48 million … leaving the city of Baton Rouge with a 45% cut in its budget,” Coady wrote. “This reduction would include public services such as roads, traffic control, the River Front, the River Center, the State Capitol and overall the quality of life in Baton Rouge.”

People voted. There is no doubt whatsoever what the will of the people was here and it gets defeated on a bullshite technicality. I’m through fighting. I’m ready to leave. frick this bullshite, backwards joke arse of a state and town. In a decade or less, BR is gonna just be a gigantic tire fire. The only connection we’ll all have is that this is where our parents and grandparents are buried. The rest of it can shrivel and become what the growing demographic seems to be gravitating it to anyway: shitville.

All the more reason to incorporate. Why should St. George tax dollars be going to to downtown or city services.

That is why consolidation in government is good in some areas, but in cases like these bad in others.

The Secretary of State received the petition request and the Governor said it was legitimate.

The incorporation had been debated for over five years now, and all of a sudden a judge says the petition wasn’t valid?

Unbelievable.

How much further can it be appealed to? LA Supreme Court is the end? Because if that’s as far as we can take it, it’s done. You know who butters LA State Government’s bread?

Not you. Not us.

The issue is St. George hasn’t proven it can support itself. That’s why they keep getting ruled against

The first circuit opinion was not over the facial requirements of the petition.
Have you read the opinion?
Do you really think it it a reprise of the Edwards certification?
They are completely different.

Anyone know the timeline of the LA Supreme Court? When could the case be heard?

Define “overwhelming”.

54-46 at the polls seems pretty solid to me.

It won with 54% of the vote and that only included voters within the SG boundary. A lot of people are also against SG that live within the boundary.

Very true. The backers of the Broome suit have ties to national organizations, some have Soros (yes, the boogieman) connections.

For the downvoters, Together Baton Rouge, Broome's main backer and active opponents of the St. George movement, is an affiliate of the Industrial Areas Foundation. This group was founded by Saul Alinsky (who wrote the playbook for modern leftists radicals), receives frequent donations from the Open Society Foundations (Soros), and gave training and financial support to young, up and coming politicians such as Barack Obama and Lori Lightfoot. The also headed the Road Home Program, which speaks to the level of corruption in their ranks. Their current form mostly uses faith-based organizations that can hide from scrutiny to push their far-left ideals on inner city communities. (Few people are less trustworthy than "ministers".)

I’d prefer to hear more names of the local “movers and shakers” who were against the incorporation. Those rat, gutless, yellow, piece of shite motherfrickers should have their names plastered all over town so we can know who NOT to support anymore.

Further, this was EBR’s last chance to take a step forward. It was the last chance to stop the bleeding as people continue the total exodus to Ascension and Livingston. Today our mayor finally gave anyone on the fence a reason to flee.

The will of the people was unfairly thwarted. We did everything we were supposed to do and were told we couldn’t have it. So bring your property taxes to neighboring parishes who know how to spend it.

It’s time to go.

I've been saying this shite since they pulled out the race card. It's not going to happen. Vote with your feet. If you must stay in LA, move to St. Tammany and get a piece of the pie while your current property is still worth something.

With their mayor getting caught trying to sneak through a drainage tax, crime rampant and the parish crumbling with trash and litter, They haven’t been active lately. They will likely surface at election time to tell us how great things are and how they are helping to get things done.
