Start putting weight gain in her morning coffee. Try to sneak some eye drops in her water bottle. That way hopefully the next time she is getting plowed by Jody she shits all over him.
After getting with the lawyer I would go as long as possible making her life completely miserable, then when she is almost at rock bottom give the papers.
