The flaw in assessing tax based on the MSRP is that the MSRP is not the FMV of the vehicle. The FMV of the vehicle should be the price that the manufacturer sells it to a dealer willing to purchase the vehicle, an arms length transaction between a willing buyer and seller. The IRS, and the states, perpetrate a fraud when they knowingly insist the FMVs of prize vehicles are the MSRPs used as starting points for negotiating an actual sales price.

I don't understand why some prize winners haven't sued the promoters of contests for fraud. They knowingly overstate the value of the prize causing economic damage to the contest winners.

No one has a title when they get a loan. You sign a power of attorney allowing the bank or whoemver to do the title work for you. Navy Fed, my bank, loaned a buddy of mine stationed at P'cola money on a new Vette he won in a tournament hole in one contest that was this exact same situation.

This is very interesting to me. My wife and I had a discussion about this just last week regarding the raffle of a $60,000 car.

I'm no accountant, but the conclusion I came to was that for someone to come out on top winning it assuming they are not in a financial position to go out of pocket on the taxes, they would at least have to have a current vehicle that they could liquidate to pay at least half of the taxes and then secure a loan for the rest. In that scenario, let's say you have a vehicle that you have payed off or payed down that can be readily liquidated to pay $10,000 on the tax bill. Now, all you have to do is secure a loan for $10-$12,000 or so and that's you're price for a $60,000 vehicle.

Am I about right?

Friend of mine won a truck in some radio station contest. He had to drive it for a year with all the trashy advertising on it before he could get it repainted

Just use the new vehicle for collateral on a regular auto loan.

The only problem is that if they are financially destitute they may not be able to pay any note.

In that case, yes, they would just sell the car at a discount to pay the taxes.
