If there's one way for a temporary, part time 16 year old high school kid working a summer job (read: highly unskilled, unreliable, and uninterested labor) to load passengers that results in "fun and exhilarating ride for all" and another way that 16 year old can load the exact same passengers that results in "headless 10 year old", that's a gross design flaw.
Whether Little Jimmy gets to be 11 or Little Jimmy gets a casket should never be able to be decided by whether or not the hornball running the waterpark ride gets distracted by a girl in a bikini.
Go directly to jail. Do not pass Go. Do not collect $200.

At first I was sympathetic to the schlitterbahn guys because I love the company and their parks but then I read more about what a shitty job they did in this park and at their other parks. Not only that, one of the brothers is a real piece of shite who abused his wife. They all neeed to rot in jail.

As did I, and I agree. It’s pretty weak sauce. I’ll say this though. There may or not be negligence on the part of the park, designers or what have you, but I’m going to say this for posterity... lawyers will be the end of FUN in America. Mark my words.

There was no age limit on the ride, only a weight limit. They weigh the participants prior to the ride, allegedly.

I was reading those guidelines and one design frick-up was so obvious... YOU NEVER put an obstruction in a KNOWN travel-path. Its an absolute!
It was known that rafts sometimes left the slide. And there were metal obstructions in the "flight path" (or potential flight-path".
So this incident was literally waiting to happen.
Also, Velcro in chlorinated water, subject to UV light, plus adhere/release cycles x 10,000... that shite does NOT remain anywhere near "new strength" after a few days in that environment.

Article said he was 4’11 and minimum height to ride was 4’6. So he met the requirements

Any time is a good time to bring that up. From our ultra litigated society we now find ourselves living in, to our politics, lawyers are squeezing every bit of life out of life itself, and quite honestly, I can see why anyone with the means would be very hesitant to venture into anything that might be a feeding ground for lawyers like an amusement park especially. frick that. Better off investing in bubble wrap with warning labels all over the place that tell people not to confuse it with tide pods and put it in your mouth.

There were multiple opportunities to prevent this, at several times and using several methods, and the park owners didn't take advantage of any of those.

The New Braunfels Schlitterbahn is the Best water park in the country.

I was working in KCMO the day that this happened and it was all over the news so I've been following this story closely. The designer and owner of that water park are facing 2nd degree murder charges from this incident. I believe that kid's dad was a state rep and he was pushing very hard for a murder charge (and succeeded).
