Question for OT Lawyers and L.E.O's

My house was broken into yesterday while the wife and I were at work.

One pistol, a knife, some jewelry, a spare set of truck keys and some petty cash were taken.

There was also some stuff stashed in the shed near a door they left unlocked that they were going to come back for.

Crime scene found blood where they cut themselves in multiple places and got good samplesif they have been incarcerated then their DNA will be on file. In addition I had serial numbers so if the gun gets pawned then they should catch them.


My question is as follows: what potential charges and penalties could they possibly be charged with if caught? I know that is a big IF.

Ummm. Burglary?



Technically it could be Aggravated Burglary because they stole a firearm but the DA ain’t gonna fool with that.

conspiracy to commit theft( not sure if that is a thing or not)

Theft is when you have permission to be somewhere; burglary is when you don’t.

Example: you invite me over for drinks and buttfricking and I steal your laptop-> theft. I kick in your door and steal your laptop and buttfrick you against your will-> burglary and rape.

I thought burglary was the entering of the building with the intent to steal. And once you actually stole something, theft was tacked onto it.

Theft is different than robbery, which involves intimidation or force.

Some jurisdictions call it breaking and entering if it is not a home that is broken into or some only call it burglary if it is at night

I figured on the following:

Simple Burglary
Larceny (theft under $5000)
Theft of a Firearm
Illegal Possession of a Stolen Firearm

Am I off base or am I missing one or two other things?

No but the responding officers had a few suspects just based on the area I live.
