He didn’t.

Her actions fits the definition of Texas manslaughter almost exactly.

The prosecution even focused their angle along those lines by emphasizing the inattentiveness required.

If the jury was made up of dumbasses they would use that to carry the legal term of murder.

Hence they found the murder charge.
