Murder involves motive, a true intent to kill. She’s just a dumb broad who probably never should have been a cop who thought she was being attached in her apartment.

I believe she’s guilty of manslaughter. Gross negligence on her part.

I'm not saying I agree with the verdict, but you don't understand the difference between intent and premeditation.

Intent can legally be formed in an instant. It's whether the offender, in that instant, desired the consequence of his act. Raising the gun and pulling the trigger is intent to kill.

Whether you planned to do X when you went in is absolutely irrelevant. The classic example is a bank robber intending to go in and simply rob the place, with specific instructions from his lookout to not shoot anyone and his agreement not to do so. While he's in there, someone gets fidgety, and he freaks and shoots them. He had intent to kill when he pointed the gun and pulled the trigger.

But seriously, I remember when I heard the details of the story on TV and they mentioned that she opened the unlocked door. I thought, “Who the frick doesn’t lock their front door in a city like Dallas at a huge apartment complex late at night? Strange.

Okay, so what do you think happened?

Did she: Accidentally go into the wrong apartment, confronted what she thought was an intruder in her apartment, shot the intruder and then realized she was in the wrong apartment. Freaks out and realizes her huge frick up and makes attempts to cover it up after the fact.

Or did she: Intentionally say, “I’m gonna walk into this guy’s unlocked apartment and murder his black arse.”

One is a colossal frickup and fits the definition of manslaughter. The other is murder.
