Young baw is being extradited to Seminole county. This is just north of Orlando, where all of the Trayvon/George Zimmerman circus occurred. They love them some media trials up there.

Is he tied to any of the incidents where someone actually died? If so he could get murder or manslaughter since he was committing a crime which resulted in someone’s death.

100% this gets plead down. I doubt any prosecutor wants to try to explain the intricacies of swatting to a jury box of blue hairs and wants to try to definitively tie this individual to an account that apparently is still active while he is incarcerated. Add to that the kid is 17 and likely doesn't have the resources to mount a good defense and you get a negotiated guilty plea with less than a year served and a long period of supervised probation.

Throw the book at this punk. Put him away for life.

However,

I'm not a fan of police having carte blanche to raid homes and businesses at gunpoint and an itchy trigger finger over one unverified anonymous call.

Both of these problems need to be addressed.

Swatting will be broken down into a number of component crimes, such as wire fraud.

Proving he used interstate communications to lie to police is easily provable.

Imagine someone calling your local cops and pretending to be you and saying you are about to kill your whole family. A swat team shows up to your house and proceeds to point a gun in your face and potentially kill you and your dogs.

Represented a guy in Thibodaux whose ex girlfriend pulled this shite on him. She told police he was barricaded in his house with guns threatening to kill people.

Swat and everyone else showed up at his house around 3 a.m., lights, bullhorns, AR 15s, etc.

He was sleeping. Arrested him and confiscated about 6 weapons, pistols, rifles and shot guns, some nice.

Charges eventually dropped, ex not charged.

To my amazement he eventually got his weapons back.

Interstate commerce is the favorite play in the fed's playbook, and they will use it. I still think given the factors I mentioned this will be plead down, but we'll see. They may want to try and send a message. They've done it before, but this guy isn't Kevin Mitnick. He's just a kid with a VPN.

Already has

quote:

On December 28, 2017, a fatal swatting incident occurred in Wichita, Kansas, United States. During an online dispute between Casey Viner and Shane Gaskill, regarding the video game Call of Duty: WWII, Viner threatened to have Gaskill swatted. Gaskill responded by giving him a false address for his residence, one that was occupied by an uninvolved person, Andrew Finch. Viner then asked Tyler Barriss to make the required fraudulent call to initiate the swatting. Wichita Police responded to the address, and as Finch was exiting his house, police officer Justin Rapp fatally shot him.

Barriss pled guilty to involuntary manslaughter and many other charges from unrelated incidents for which he was wanted. In March 2019, Barriss was sentenced to 20 years in federal prison.[2] Viner was sentenced to 15 months imprisonment and two years supervised release for his involvement, while Gaskill was sentenced to 18 months imprisonment. Rapp was not charged for Finch's death

You call or report a false report to the police that you killed someone or doing an terrorist act on a location you want the police/swat team to show up at to screw someone over.

I mean, he could have been using both

The article states where he fricked up was using some peer to peer chat app where an investigator was able to capture his actual IP.

I agree, but leaking someone’s personal information so that they can get humiliated or stalked is pretty deplorable

I'm pretty sure some dude in Kansas or something like that got killed in a swatting incident a few years back.

Eta- I see someone posted the story above.

Sentence

Barriss

20 years in prison (parole possible after 17 years and 1 month)[1] plus $10,100 fine and 5 years of supervised release

Viner

1+1/4 years
in prison plus 2 years of supervised release

Gaskill

1+1/2 years
in prison

So the 1st guy threatens to send a swat team to the 2nd guy. 2nd guy says "frick you, do it" and gives a fake address. 1st guy calls 3rd guy who calls 911 for a hostage situation at 2nd guy's fake address. Police show up at fake address and execute the 4th guy who did nothing wrong.

But the 1st guy, who started all the shite, gets 15 months in jail.

2nd guy, who did nothing but call 1st guys mom a whore and gave a fake address, gets 18 months.

What the actual frick?

I don't give a shite. I spend my time trying to limit my interaction with police. Some little shite like this comes along thinking he's playing a fricking game and puts my life at risk from some trigger happy cop who thinks he has the case of his career? frick him. Like I said, 50 years.
