For charging and prosecution purposes if a product is in retail packaging (not in bulk) most jurisdictions allow for the use of the retail price even if it is still in the wholesale phase of the chain of commerce. In that same vein if you shoplift something from a store that is on sale the full MSRP (again in most jurisdictions) can be used to determine whether it is a misdemeanor or felony and for restitution.
