Why would they use an illegal activity to front another illegal activity?

In fact, a Material Witness may be arrested if they refuse to cooperate with a court order/subpoena.

Non-sequitur. Doesn't directly relate to this situation.

Furthermore, persons may be excluded from a crime scene (including a business or their own home) while a warrant is being obtained.

Shooting happened outside, no? How far do a crime scene's borders extend?

All of this is black letter law.

OK. We can all quote black letter law. The trick is applying it to the facts of a particular situation.

Better than violating Constitutional rights (presumably). He hasn't a party to the crime, was he?

Look, I know the guy seems like a shady douchebag. I'm just playing Devil's Advocate.

I knew a little health food store up here when I was in college that was similar to this. All it had on its shelves were a bunch of expired vitamins, but they had a cooler full of Snapples. Each bottle of Snapple was $21.

He knows there will be bad evidence to show he was part of a crime or crimes. This lawsuit is a preemptive strike to get that evidence thrown out as fruits of a bad search. In other words he wants to erase legally speaking the crap he knows they will find or have already found.

Do you know how it went down? Because you are acting like you do. I have been at major crime scenes and four hours goes by damn quick. By the time EMS and the Coroner are done, Crime Scene finishes their thing and Detectives are ready to take a statment, five hours isn't unreasonable or an abuse.

You and I both know that the video system was inside the store and that very much makes it part of the crime scene. Don't try to be cute here. They shoot someone in the back of your ten acre property and want to seal off your house...NO. In this case, the store is well within bounds.

That's great. Another non-sequitur.

Oh wow. So if there was a store across the street that also had video surveillance, that would be part of the crime scene too?

Didn't the shooting happen a few feet outside the door? Seems like the entire premises would be part of the scene.

This guy is less shady than the ISIS sympathizing MetroPCS store owner/operators participating in the protests.

Jesus. You sound like one of my retard ultra lib law profs and their ridiculous hypothets. Are you saying the store WASN'T part of the crime scene? The shooting happened feet from the front door. Do the police have the right to seize video of a potential crime? Do the police have the right to secure the premises containing that relevant evidence while they obtain a warrant? Then yes, the store across the street can be secured or at least they can enter and guard the relevant evidence pending the warrant.

The parking lot is private property that is connected to the store. Hence, if you park there for hours on end as a non-customer they may have you towed. The crime scene is on the same property. It's not across the street. Get real.

Keep throwing out "what ifs" like they have any bearing on this case or any other case in real life.

God forbid someone make you think a little test the limits of your assertions. Must be nice to be someone who has all of the answers all of the time. I wasn't like in in law school and I'm not now either. My life would probably be easier if I were.
