I would sue whoever painted that big stupid mural right next to the 8 piece fried chicken for $4.99 sign.

If what he reported is true, he should have taken the violation of his rights and shut up. Murica!

Meh, if you are 10 ft away from a fatality, you can pretty much assume that you will be detained, questioned and have to write witness reports for what you saw. This is SOP. If he didn't want to be hassled that night, perhaps he should have minded his own business, literally.

The dude is shady at best no doubt. I know this as fact from my younger days of doing drugs. He had other things going on as some have suspected. TIFWIW.

He is claiming that more than that happened.

Hasn't his story changed a few times? Id say chances are he is lying again. He just doesn't want the out of towners to get the locals to burn his store down. I'm laugh when they investigate him and all his shite is out on the table.

They detained him for 4 hours so they had time to get and execute the warrant. Which they apparently did at 5:00 am according to the other thread related to the warrant. What's the problem again?

Also, if they confiscated his phone, how the hell did he share the video with the media?

I don't know, but this is what his law suit is claiming.

Um

What are the merits of this law suit?

What you are saying literally true, but that's also a subtle way of advertising the offer to purchase SNAP credits also. Trust me on this.

Actually, you may detain a Material Witness in order to obtain their statement. In fact, a Material Witness may be arrested if they refuse to cooperate with a court order/subpoena.

Furthermore, persons may be excluded from a crime scene (including a business or their own home) while a warrant is being obtained.

All of this is black letter law.

I guess the alternative would be allowing him to destroy evidence
