OT Lawyers - DUIs.....what if I start drinking after the wreck?

Let's say I was drunk and caused a wreck. The cops aren't there yet, but I have a bottle of liquor in my car and I'm drinking it as the cops arrive. Can the law prove in court that I was drunk before the wreck or would it just be a public intox?

How about not drinking and driving to begin with? An Uber is cheaper than the wrong answer to your question.

I've heard of keeping a shorty of vodka in your car for when you get pulled over. As you get out of the car, with keys in your hand, kill the bottle. They can't prove you were drunk before you drank it.

BAC is at its highest 30-45 min after consuming alcohol. Breathalyzers measure how much alcohol you had in your system at a prior time. They make you put the bottle down, wait 20 min, then take your BAC. Having just drank a few shots will not change the BAC recorded....all that fresh alcohol is still in your gut, not yet absorbed into the blood stream.

Always ask the guy you're selling the weed to if he's a cop. He's not allowed to lie, and if he does, the charges will be thrown out. Foolproof.

AT BEST, you'd still get arrested and have to bond out, lose your license for a while, and hire an attorney to pitch that defense and you would still be paying ALOT more than the price of an uber
At worst, the prosecutor argues that no reasonable person would start drinking after an accident when they know the cops are on their way and that you were just using it to cover up the fact that you were already drunk and you still get convicted.

It works. Cops hate it but there's nothing they can do. That's why they spend a lot of effort trying to make people believe it doesn't work.

I've heard this story a billion times and it always ends with "and they couldn't do shite to him."
If you do this, you will be arrested and will be charged.

Why don't you just run off? If they can't find you for a day or so, they can't prove you were drinking.

When I was a prosecutor I tried a case like this. Jury didn't buy it and he went to jail.

A guy I work with clipped truck mirrors while passing in grand Isle. He had been drinking. He is an alcoholic. Anyway, so he leaves the girlfriend with the truck to wait for State Police to show up, while he walks to the store. Grabs a 6 pack walks back and drinks a couple. When the trooper gets there he asks him why he`s drinking and he said his nerves were bad. Nothing else was said or done.
