Butt chugging is where it’s at, my man.
Unscrew the cap, insert the bottle neck into you b-hole, place your hands on the ground and kick your feet up on the hood of the police car, then starts twerking while shouting “YOU CAIN’T PROVE NUTHIN!”

I’ve seen a woman (also by chance an attorney) try this defense. She claimed she walked to an establishment and had a drink after the wreck.
It didnt work.

quote:a buddy of mine did this in high school. country road, sheriff knew everyone. they found his car in a ditch, with no one in it. Sheriff goes to the house and he is asleep in his bed. dude wrecked then ran home and got in bed.
Why don't you just run off? If they can't find you for a day or so, they can't prove you were drinking.

It might work if you got a lazy cop or lazy prosecutor, but that defense is usually offered when the cops don't find someone until they've left the scene of the accident. Then when they find you at home, you open the door and polish off a liquor drink with them standing there.
If you're on the side of the road drinking, you'll probably forget that you are sitting in the driver's seat, on a public highway, with the keys in the ignition, drinking. You'll still get a DUI. If you manage to avoid all of that you'll probably get to listen to a retrograde extrapolation expert analyze what you drank at the scene compared to your BAC to say you were drunk before the wreck.
If you're gonna try that, you may as well just throw the keys as far as you can into the woods and run jump in the passenger seat and claim the real driver fled. And that you don't know who that driver was. This only works with an old car so they can't download the event data recorder, btw.
Just call an Uber.

two different times I know of people it worked for.
First one he got pulled over and knew he was drunk. Stepped out before cop got to truck spun the top off a pint and started chugging on it. Refused field sobriety and field breathlizer and asked to be taken to office for breathilizer or blood drawn. He knew that would buy the time he needed for a lawyer prove later that cops couldn't prove he was drinking prior to that moment. Took almost an hour to get him back to station and administer tests. Right before they were fixing to make him blow the shift captain came in cussing and knew what he was trying to do. Roughed him up a little and threw him in the drunk tank for the night and wrote him a public intoxication ticket and impounded his car. Lot cheaper than a DUI.
Second guy wrecked and had bottle in his back pocket waited for cop to get there and as he pulled up he opened up the bottle and started drinking. Cop ran over an tried to take it from him and ended up hitting him several times and tazed him. When they got him to station to blow he refused and wanted blood drawn. OF course it was high. He smiled and said you cant prove I had one sip before your officer attacked me, His lawyer counter sued for the attack as it isn't illegal to consume alcohol in the general public only if you are intoxicated. and that intoxication happened as a result of the drinking but only after time had elapsed and was no longer in the public but in police custody for speculation of DUI. It was dismissed and he in return dropped charges on the officer
