I'm no legal expert however I was in a similar accident a week ago. I felt okay leaving the scene and the driver of the other vehicle admitted fault in the accident. I mostly felt okay for three days following the accident except for normal soreness and some minor neck and back pain. I decided to retain a lawyer the day after the accident after I realized that he only had minimum coverage and my claims were going to far exceed his coverage. Three days following the accident I developed pretty severe sciatica nerve pain. I've been seeing a chiropractor and it has helped but I'm still not yet feeling quite right and will be missing work until I do feel better. I did not obtain a lawyer to screw anyone over or to get some big payday. However, in the litigious society that we live in it is absolutely in your best interest to retain legal counsel if you believe that the matter will be contested. For me, piece of mind is worth it. For the record, I have not paid the attorney anything yet and he will only be paid once a settlement has been reached. Any decent lawyer will at least hear the circumstances of your case to determine if they have interest in taking the case without charging any kind of fee. Good luck and I hope that your wife is okay.

Plaintiffs attorneys do not require money up front for auto accident cases. Payment is based off of contingency on a settlement or verdict.

ITT, welders and roustabouts try to give terrible legal advice to OP.

does your wife work? if not, i would be going to the chiro 3-4 times a week as if it were a job for a year. Rack up that bill.

Boozie, help me on auto question. Kid in MVA, no question, other party at fault, made claim against carrier, they just sent a letter saying they had an active policy, but the adverse driver was specifically excluded as a driver. They denied coverage on the accident.

I know we can pursue them directly. Is it worth it? Should I pursue the carrier anyway? Thoughts?

Festus, you know I can't give legal advice on a message board.

But I will say that one of the shittiest things I have to tell clients is that most people are insolvent and a judgement against them is usually not even worth the paper it is written on.

Make sure your wife goes to the hospital and complains of headaches. Otherwise it's hard to get the maximum settlement from the insurance company.
