Hire a lawyer, who has a good accident investigator. Good investigators will do a neighborhood canvass. Never know what will.

The he said she said cases are pretty rare these days unless it's a podunk intersection.

It's a heavily trafficked area, just happened at 6:45 on a Sunday morning.

Glad your wife is OK.

I think someone might have mentioned here that you need to lawyer-up ASAP.

I agree. There's an event data recorder (EDR) on the vehicle. Even though it's totalled, you'll probably want that information for your case. It will show what happened over the last 30 seconds of the vehicle's journey.

Sometimes EDRs show things that don't help their owners' cases.

Good luck and possibly pics of your wife?

That's not how that works at all. If you care, no pics =no answer. You don't answer and then request pics. That's creepy.

This. What state are you in? Get her to a hospital within 24 hours of the accident if not right now to be checked out. She'll need to follow up with a Chiro or Physical Therapist for at minimum deep tissue injuries. The ER doc that sees her might recommend she go see a ortho doc as well as have CT's or a MRI while in the ER.

Don't fret over the bills, thats why you have health Ins and if not the at fault party's auto ins will pay for them.

Lawyer up.

A personal injury lawyer will not only advocate for your wife in this matter, but will make sure she receives all the medical treatment she needs to become whole again as well be able to lower the cost of the medical bills and get her money in her pocket.

Good luck.

The entire O-T is the clinical definition of "creepy".

I gave the OP a pass, there was a traumatic event this morning as his wife was coming home from visiting Jody.

Is that better?

All depends on the police report and who is marked at fault. Witnesses would be a big help. The cameras set up at intersections don't record unless they are red light running cameras. You are better off contacting local business or residents to see if they have security footage if your wife is listed as the vehicle at fault

How comprehensive is your insurance policy?

You should have medical payments (no deductible) and under/uninsured motorist coverage.

What kind of car did the guy drive? That is often an indicator of what kind of policy they have.

(I'm not a lawyer, I'm an insurance agent).

Granted that this accident sounds pretty serious, first be happy she isn't seriously injured. Second, realize that absent witnesses, a camera or some other evidence to the contrary, his insurance is going to back his story just like yours is going to back hers. They will probably end up splitting the costs at the end of the day.

What is "her money"? Why does everyone think a car accident ='s a payday? Get your car fixed/replaced and get medical covered. This bullshite of demanding $50k every time someone bumps into your vehicle is why we pay the highest insurance rates in the country. The lawyers with the big offices right on I-10 laugh at every one of you behind your backs.

Why hire a lawyer? Is she hurt? Let the insurance company figure it out, can you be sure the other driver is not right?

What is the OPs goal? He said his wife is okay, so is he trying to get the car paid for! If so a lawyer is going to laugh at him and charge him $250/hour because there are no injuries , and chances are the opposing insurance is a min policy, if the op has full coverage, let the insurance company figure it out

Step 1
Go to the ER ASAP!!!Symptoms of whiplash can show up 12 to 24 hours after an accident. Headaches, nausea, confusion, & loss of memory are common symptoms. Your wife needs to be forthcoming with any and all soreness & pain so they can accurately assess her injuries. Make sure they take Xray, MRI, & CT Scan.

Step2
Notify your insurance company of the accident so they are in the know. Find out if you have Med-pay, & what your limits are.

Step3
Lawyer up with a personal injury attorney.

Step4
Call local law enforcement to find out when a copy of the police report will be available.

Do all of this today. The earlier you start the process the better it will support her case.

I have benefitted from two car accidents in the last 3 years. In the future tell her to stay in the car and ask for transportation to the ER. Also make sure she gets rehab. Don't miss any appointments.

Good luck!!!

So you are advising him to go put up a 2500 retainer to possibly prove his wife did not cause the accident?

Normally I'd suggest calling a lawyer first thing tomorrow, but actually I think the legal gurus of the OT should be able to guide you through this one, step by step. Before you accept a quick check, check with the OT.
