So everybody has a cute saying and cool pictures but no one can give any real reasons to go see a lawyer

A car hit your wife's fast and hard enough to make it flip more than once, neither vehicle would have been operable, and yet there is no police report????

I had an accident last year that totaled both cars and was 100% someone else's fault. I just let it play out, the other guy lawyered up and ended up successfully having it deemed 50/50 fault and I ended up having to switch insurance companies because I was dropped by mine after they paid for my car for being a "high liability". This was only the second claim made in 6 years, the other being a fender bender that was my fault.

Now we can debate the merit of shitty insurance practices, but the fact is the threat of getting boned by dishonest fricks is always there.

Because the other driver is lying about fault.
Because that will cost OP and his insurance company thousands of dollars.
Because the other driver will lawyer up.
Because a PLAINTIFFS lawyer works on contingency, doesn't bill hourly or charge a retainer.
Because she does have damages. And probably will wake up sore tomorrow.
Let's say he was texting and driving (likely), how are you, an average Joe, going to get those records? Just call him up?

Go see a lawyer, because not everyone is as scrupulous as Tigerpaw123.

Somebody ran a red light and ruined someone's life but isn't accepting personal responsibility for their actions. Let the lawyer fight your fight since they understand the laws better than you.

Actually it's because (1) Louisiana has the highest number of uninsured motorists and (2) insurance payments also go to cover the cost of that lovely system implemented back in the '90s that us supposed to track uninsured vehicles and fine the owners.

Not saying ambulance chasing is a noble profession, but blaming them for inflated insurance premiums is ignorant.

And to be honest, in the grand scheme if nobody was hurt and both parties are insured even the worst case scenario isn't THAT bad. The real concern is cases where someone is injured and there is a real risk of huge medical bills and possible excessive damages claims.

That being said, if one side lawyers up and the other doesn't it can be a real headache in ANY case.

A big problem is people that reflexively go to the ER and suck up healthcare resources so they can make a buck. Look no further than the guy earlier this thread recommending CT and MRIs ($$$) and physical therapy.

Exactly. This was not a minor accident. Someone ran a red light this morning. If the other guy is at fault, then he is already making false statements about the accident. A lawyer is a really good idea to protect yourself and your wife. There is a very good possibility he is contacting a lawyer tomorrow. Maybe to protect himself, or maybe to claim the wife was at fault. The police already seem like they aren't holding him responsible, or vindicating the wife.

What if the wife was at fault? She didn't intentionally run a red light & truthfully believes she didn't. It was early morning, the sun was glaring on the lights, she's not paying attention, not a lot of cars on the road... She is daydreaming through the intersection because she didn't notice the red light. A lawyer is needed in this situation as well. Speed limit, flow of traffic, the visibility of the intersection, what were both drivers doing on the roads at this time of day are just some of the factors a good accident investigator can use to determine if one of the drivers was at fault.

Hiring a lawyer doesn't mean you are exploiting the situation. You are protecting yourself.

I can't offer anything of merit because I am an lawyer who deals with this type of situation on a daily basis. I just don't want to be seen as soliciting, but I am intrigued by your opinion.

Again the insurance company has the most to loose and they are well equipped to investigate and defend

He said she was okay. Does sore equal injury? And my argument has been based on no injuries, if she is injured and/ or wants a payday....lawyer up

The accident happened this morning. How do you know she isn't injured? I'd bet the adrenaline is still coursing through her veins.

Most lawyers will have a free consultation. Yet you're here telling him unequivocally that he doesn't need to speak to a lawyer at all.

That's why we're all so curious as to your motivations/ source of your ignorance.

If she is injured it is a different ballgame, but in absence of injury do you really think they need a lawyer? And can you confirm that in absence of injury that no lawyer would take this case on contingency?
