OT Lawyer Baws -- NFL (Saints) Lawsuit

For all you law baws.
Why did the ticket holders file it as a class action? You only need one ticket holder to seek an injunction, and surely you could have found one who was nondiverse. Then they could have kept it in CDC, which might actually have given them an injunction.
Filing it as a class action gives them a slam dunk removal under the Class Action Fairness Act. You are all but guaranteeing you will be in federal court.
Just my $.02.

Morgan has let it drag out far longer than I thought she ever would.

This is what happens when people of a state are brainwashed into thinking that everything deserves to be a lawsuit. Thanks, Gordon.

She is in a tough spot.
Of course, she could always grant a TRO with a $200 million bond. Then the game would go forward because no one could post the bond.

The Eastern District Clerk would freak.
Non way you could get an insurer bond that quick. It would have to be cash.

Sure. It has nothing to do with big insurance and spurious denials of legitimate claims.

Could they really stop the game? No way

If a federal judge issued a TRO? Yes.
But the Fifth Circuit would likely dissolve it in about 90 minutes.
My guess is that the briefing on that emergency appeal is in the can.

The fact that lawyers are sucking money out of this deal isn't going to change the fact that the game will not be replayed.
What kind of precedent would that set?

Because D’Amico just filed it for the free publicity

Season ticket holder here. Who will have to fork over the money if there was a class action? The saints or nfl. I don’t want money back if it’s coming out of the Saints organization...

Just wow. What a bigoted statement. And I’m sure there were plenty of “nondiverse” people in the suit.

Oh you don't have to worry about that. In fact you can just forget there is even a lawsuit.

No matter where it is filed or how it is styled, the suit is untenable and will be dismissed.

Amusing to me is the firm/attorney the NFL choose to represent it.

There may actually be something to this. After a particular game show debacle, Congress stepped in and made it so they can’t cheat the contestants and so that everything is honest/fair. I believe that worked because the show made its money off of advertising on their broadcast which was over federally controlled airways. Very similar to how the NFL makes their money.
And the NFL sure hasn’t been shy about including the government in their internal squabbles between the organization and the players. So they’ve already shown they’re willing to allow government intrusion.
I’m not saying it would work or that it would be worth it to go down this road, but it does seem to me like it is a possibility.
