The OP and I have been in contact. I (with the help of a fellow OT'r) know exactly what to do to break it off in these folks. I know what they did and how they screwed up.

There is some paperwork to do on the front end. Once that is taken care of I will go and take possession of motorcycle and the jackasses that are trying to extort the OP will be powerless to do anything about it.

Ok, I've just re-read the entire thread and spent a while reading MS state law pertaining to the issue.

I know EXACTLY what ploy the wrecker company owner is trying to pull and why. I believe it's completely illegal but I've got more research to do. He doesn't have the grounds to claim it as abandoned at all. He's trying to be clever. I love the way he quoted the law in his letter. I will beat anyone with their own rule book and this jackass is no different.

I'm going to go all "Wrath of God" on these folks. I love a good fight.

Arguably, under Miss. Code Ann. § 63-25-3, if they sell the stolen motorcycle, they might qualify as a "chop shop":
quote:

(a) “Chop shop” means any building, lot or other premise where one or more persons are or have been knowingly engaged in altering, destroying, disassembling, dismantling, reassembling or knowingly storing any motor vehicle or motor vehicle part known to be illegally obtained by theft

quote:

in order to either:

quote:

(ii) Sell or dispose of such motor vehicle or motor vehicle part.


Pursuant to Miss. Code Ann. § 63-25-5:
quote:

(1) Any person who knowingly and intentionally: (a) owns, operates or conducts a chop shop; (b) transports any motor vehicle or motor vehicle part to or from a location knowing it to be a chop shop; or (c) sells, transfers, purchases or receives any motor vehicle or motor vehicle part either to or from a location knowing it to be a chop shop, shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not more than fifteen (15) years and by a fine of not more than One Hundred Thousand Dollars ($100,000.00).


I mean, if they want to play games with legal codes.

I hope this works out for you BruceJender. This is some slimy stuff right here. You'd think the threat of a civil lawsuit (even in small claims court) would get them to to realize they're facing a larger loss than the gain they hope to reap.

I spoke to BruceJender tonight. Nice guy BTW. I think we have everything straight and I have a plan of attack.

I'm going to get the ball rolling tomorrow and start making phone calls. I drafted a cease and desist letter to the company in possession of the motorcycle. It will probably be dropped in the mail in the afternoon depending on how the phone calls go throughout the day.

I'm going to escalate this very quickly if I don't get the response I want. My expectation is that I pick up the motorcycle on Friday.

It's now a challenge to see if I can get this done by then.

I hope things go well so that BruceJender gets his motorcycle back, and that we get some great updates.

If the shop/wrecker company gets screwed over, that would just make it more entertaining.

I contacted law enforcement this morning. I still have a few folks to talk to but I'm getting to the bottom of it. This one is going to work out for the "good guys" and not so good for the "bad guys". The place that actually has the motorcycle is digging a hole that they might find themselves trapped in.

I may not be able to pick it up on Friday but there is a reason and I'm OK with it.
