There are exceptions built into the bill, but an employer should be able to disqualify a candidate for any reason they want.

DOT required testing has marijuana in the panel. It is required for people who work in certain transportation qualified jobs.

Also, people who work on equipment for commercial trucking companies, like mechanics, and people who operate or work on DOT regulated pipelines. That includes pipeline welders. DOT requires pre-employment testing. That is the reason most oilfield related companies test field employees.

Drug testing is expensive, so most companies don't do it unless they have to.

Divest from all drug testing stocks. Without the long duration in the system from THC metabolites there is no reason for drug screening. The rest of the stuff only sticks around for 72 hours at most. Anyone who is so addicted to drugs or alcohol that they cannot stay clean for 72 hours is gonna be noticeably tweaking in the interview process.

Seriously. Why not just have no law on this? If a company wants to high people who test for marijuana then they are free to do so. If a company prefers not to, it is just part of their company policy.

If I were a company that didn't want to hire people who tested positive for marijuana I would require everyone applying for a job to submit a recent drug test when they come for their interview (or is that illegal?)

That way, you can have other reasons to justify why you hired someone else.

The government started the irrational fear over marijuana and got us to this point where everyone is tested.

Seriously, there are jobs that are drug testing for marijuana that have zero business wondering about your after hour habits.
