Neurologist said he is considering filing with a judge to remove my FIL from his finances

My FIL was diagnosed with Alzheimer’s around 6 months ago. While it has been concerning seeing his cognitive decline, he is still pretty much all there for the most part.

But a recent checkup at the neurologist revealed things are worse off than anyone thought. The doctor asked him to draw a clock that read 11:30. My FIL drew a circle with a 1 and a 4. He said he knew a 12 went somewhere but he didn’t know where. And that was that.

My wife attended the appointment and said he didn’t even really comprehend how weird it was to not remember how to draw a clock. Like he’s not aware at all of his own cognitive decline.

My FIL also couldn’t remember who he had an appointment with about one of his bank accounts. He just knew that he was moving a substantial amount of money around but he would have to check his notes later to see who it was with. Obviously this was really concerning to everyone in the room.

The doctor brought up taking my FIL’s keys and his ability to do his own finances. He told my wife as an aside that if they aren’t able to make necessary changes ASAP, he would bring it to a judge.

Has anyone experienced something like this before?

I tried googling, but I couldn’t find any evidence that a doctor could go to a judge to remove a person’s ability to do their own finances. It’s not that anyone wants him to continue doing his own finances, but the threat from the neurologist unnerved my wife a good bit.

Anyways

Prayers for your family. Imagine going through that. Being blissfully unaware of your loss of your hold on reality.

And everyone who has to watch.

Just terrible.

It’s the worst part IMO. Though maybe it’s grace. Imagine being aware of it?

Family has to accept this diagnosis. Take his keys. It won’t be easy.

If he has firearms, take all his ammo. If the guns disappear he will obsess over it but if he can see the guns but can’t find bullets he will just think he mislaid them.

Talk to an attorney and get a POA set up now before he is no longer capable of signing. It does not have to be effective now but can spring if/when his capacity is diminished.

Step in on the finances asap. There are vultures out there who will drain him completely

But is it a legal warning?

Obviously he’s not of sound mind to handle his own finances and driving. My question is can a doctor go to a judge to force it?

I ask because my wife is 1) freaking out believing she’ll be liable if a judge gets involved after being at the appointment and 2) trying to figure out options for the impossibility of taking away her father’s control of his finances

You should consider the power of attorney before he’s no longer with cognitive function.

I can understand the doc telling a judge about the driving stuff because he could be putting himself and others in physical danger.

Finances? That seems over the top (although someone needs to step in)

This. It is a very serious warning from the doctor. He has probably seen his patients be taken advantage of. Let's say a guy has three kids. Two are good kids and the third is a deadbeat. The third can swoop in and clean the dad out before the other two kids know what happened.

I don’t know how much he could do legally. But you absolutely need to consider at the very least taking over his finances. The test he gave him is a pretty typical one we utilize to determine cognitive decline and severity and he would be at the point where he needs assistance.

He’s also VERY vulnerable to someone taking him for all he has if he encounters the right person.

Kinda an aside, but I wonder about potential liability if the warnings were ignored and FIL ended up driving and killing someone?

I’m torn on this. It’s great that the doctor is looking out for the patient.

But I don’t believe he has any business outside of that doctor’s office.

This goes down a perilous road. What if you refuse to take a vaccine, can a doctor go to a judge and do something to you?


Does this violate HIPPA? Can a doctor tell the courts your medical status?

If you don’t think it’s right, I would 100% file a complaint with the health board or whomever. Not sure who or how. If it’s fine for the doctors to do it, then nothing will happen. If it’s wrong, then your complaint is documented.
