Gotta admit I’m pretty impressed that the OT has used the proper term “venomous” snake rather than usual “poisonous” snake.

With that said it was probably a GDCK rather than a cotton mouth

I guess you never know, but I’d imagine once the kid goes home from hospital and emotions die down, they’ll eventually drop it and life will go on. They probably won’t be your best friends or let their son come to your house anymore, but they’ll realize there is bigger fish to fry than getting a couple thousand dollars out of your HOI coverage.

Had he died, you may want to worry. Since he didn’t, don’t worry.

Really hoping it does not effect my son, the other kids dad coaches his baseball team

Normally I'd agree with you.. but these kids parents have legit cause to sue. Their son has nerve damage and spent days in the hospital all because the OP retarded idea to send their son to kill a cottonmouth with a hatchet.

It's not like the kid was playing outside and stumbled into it and got bit accidently.

Bottom line is, the kid was just that, a kid. The kid was an invitee on your property. As such, you owed the kid a duty of reasonable care to inspect the property for hidden dangers and warn of or remedy them. Liability is proper because invitees have reasonable expectations that
the landowner's premises were made safe for them.

In this case, you could have discharged that duty of care by going down to the lake and killing the highly venomous snake yourself once you became aware of it. Instead, you just gave a large knife and told them to do it themselves. Probably not the smartest thing to do.

You're going to get sued and your carrier will likely settle. Just hope you have an adequate homeowners policy.
